City of Heyburn Special Council Minutes
April 29, 2008 7:00 P.M.
Council Present:
Cleo Gallegos, Dee Ray Bailey, Rocky Baker and Leann Smith.
Employees Present: Linda Dayley, Scott Spevak, Earl Andrew and Steve Tuft.
Visitors Present: Neil Justesen and William Drinkwine.
Meeting Conducted by Mayor George A. Anderson.
Pledge of Allegiance led by Mayor Anderson.
Mayor Anderson thanked Dee Ray Bailey for sitting in for him the last two council meetings.
Discuss Event Liability Insurance.
Attorney Steve Tuft referred to the city’s ordinance, in which there are a couple of requirements that need addressed to see if the council wants to impose them or waive them. The first one is if there is any commercial use of any park requires among other things personal fees and second of all that they have at least $500,000 of public liability insurance. It also indicates that for use of the amphitheater there is a charge of $500 or ten percent of the gate charges to be paid for the use of the amphitheater and we really have not addressed that. In contacting the Ansel Brown promoter people they don’t have any insurance.
Mayor Anderson: How were they dealing with other places?
Earl Andrew: I talked to their agent directly today. She said that what they do because he is not a well-known performer and is just trying to be known, they have a hard time affording insurance and that it costs about $400 per event and they have a limited budget.
Right now we have no contract, so if there is a short fall we are not on the hook for anything. Any event insurance that they get would have to come out of what they make on this deal and it is a benefit concert for the Children’s Miracle Network. All they will do is pay expenses and donate to the Saint Luke’s Children Hospital in Boise.
Council discussed public event liability insurance required for any sponsored event.
Motion by Rocky Baker to waive the Amphitheater fees of $500 and ten percent of gate charges but the city needs the $500,000 public event liability insurance must be in force for the Ansel Brown Concert. Second by Dee Ray Bailey. Vote: Cleo Gallegos - Aye; Dee Ray Bailey - Aye; Rocky Baker - Aye; Leann Smith - Aye.

Motion by Leann Smith for an Executive Session for Land Acquisition and Commerce as authorized by Idaho Code Section 67-2345. Second by Dee Ray Bailey. Roll Call Vote: Cleo Gallegos - Aye; Dee Ray Bailey - Aye; Rocky Baker - Aye; Leann Smith - Aye.

The executive session commenced at 7:18 P.M. and ended at 8:06 P.M. The executive session consisted of a discussion of Land Acquisition and Commerce. No decisions were made.
