City of Heyburn Council Meeting Minutes
September 14, 2011

Council Present:
Cleo Gallegos, Rocky Baker and Joanne Justesen. Leann Smith - Excused.
Employees Present:
Greg Richins, Dan Bristol, and Deborah Hopkins. Excused: Steven Tuft.
Visitors Present:
Brittany Bowden, Dee Ray Bailey, Tony Morley, Paul Aston, Dawn Lage, and Bill and Norma Morrison.
Meeting conducted by Mayor George A. Anderson. Mayor Anderson led those present in the Pledge of Allegiance.
Approve Minutes of the August 24, 2011 Council Meeting
Motion by Rocky Baker to approve the minutes of the August 24, 2011 council meeting as presented. Second by Joanne Justesen. Vote: Cleo Gallegos - Aye; Joanne Justesen - Aye; Rocky Baker - Aye.
Discuss/Approve Paying the Bills
Motion by Rocky Baker to approve paying the bills as presented. Second by Joanne Justesen. Vote: Cleo Gallegos - Aye; Leann Smith - Aye; Rocky Baker - Aye; Joanne Justesen - Aye.
Discuss/Approve Loan to Heyburn Urban Renewal Agency to Pay the Bills
Motion by Rocky Baker to approve a loan to the Heyburn Urban Renewal Agency to pay the bills in the amount of $1,123.40. Second by Cleo Gallegos. Vote: Cleo Gallegos - Aye; Rocky Baker - Aye; Joanne Justesen - Aye.
Discuss Building Code Appeals Board - Tony Morley
Minidoka County Building Department Administrator Tony Morley briefly updated the Mayor and council members on the status of forming the Building Appeals Board bylaws. Mr. Morley stated the City of Rupert approved the bylaws on September 13, 2011. He also stated that the City of Heyburn council members will need to submit names for people to serve on the board once the bylaws have been approved by every entity.
Motion by Cleo Gallegos to approve the Bylaws and Rules of Procedure for the Minidoka County Building Appeal Board and to authorize the mayor’s signature. Second by Rocky Baker. Vote: Cleo Gallegos - Aye; Rocky Baker - Aye; Joanne Justesen - Aye.
Discuss/Approve Party Hardy Sub Lease
Dawn Lage from Party Hardy stated that the sub lease has been signed. She updated the mayor and council by informing them things are going well and that this is their busiest time of year.
Motion by Rocky Baker to approve the Party Hardy Sub Lease as presented and authorize the mayor’s signature. Second by Cleo Gallegos. Roll Call Vote: Cleo Gallegos - Aye; Rocky Baker - Aye; Joanne Justesen - Aye.
Discuss/Approve Request to Hook Up to Water from Walter Lovingfoss
Superintendent Richins explained to the mayor and council members that Walter Lovingfoss has expressed an interest in being connected to the City of Heyburn water.
The mayor and council members discussed the their prior decision to not hook up any services to property that has not been annexed. Council members instructed Superintendent Richins to meet with Mr. Lovingfoss and explain that he must request to be annexed into the city before he can been hooked up to water.
Discuss/Approve Annual Appropriation Ordinance No. 539
City Clerk Deborah Hopkins explained to those present that Ordinance No. 539 was the annual appropriation ordinance for the City of Heyburn. She also stated this ordinance needs to be approved under the suspension of the rule for three readings in order to meet publishing and county deadlines.
Motion by Rocky Baker to have Mayor Anderson read the Annual Appropriation Ordinance No. 539 by title only. Second by Joanne Justesen. Vote: Cleo Gallegos - Aye; Rocky Baker - Aye; Joanne Justesen - Aye.

Discuss/Approve Quitclaim Deed from Walker Realty Construction
Paul Aston briefly discussed the necessity for the quitclaim deed from Walker Realty Construction stating that the deed basically dedicates 18th Circle Drive to the City of Heyburn. He stated this was the result of not having a subdivision recorded when it was originally done in 1976. This created a private street that the city has been maintaining. He further explained the quitclaim deed will turn the street over to the City of Heyburn.
Motion by Rocky Baker to authorize Mayor George Anderson and City Clerk Deborah Hopkins to accept the transfer of the deed and to execute the same. Second by Joanne Justesen. Roll Call Vote: Cleo Gallegos - Abstain; Rocky Baker - Aye; Joanne Justesen - Aye.
Tennis Court Update - Greg Richins
City Superintendent Greg Richins discussed with the mayor and council members the proposal from Koch’s Tennis Court Service out of Bozeman, Montana to make repairs to the tennis courts in the amount of $14,800. Superintendent Richins explained the contractor has concerns about doing the repairs this late in the year due to the colder fall temperatures. Superintendent Richins stated the contractor will honor the price quoted unless there is a marketable increase in the cost of product. It was decided to not make the repairs until next spring.
The council meeting ended at 7:40 PM.
