 City of Heyburn Council Meeting Minutes

May 11, 2011

7:00 P.M.

Council Present:

Cleo Gallegos, Rocky Baker, Leann Smith, and Joanne Justesen.

Employees Present:

Steven Tuft, Dan Bristol, and Deborah Hopkins.   Scott Spevak - excused

Visitors Present: 

Roy Belnap, Paul Aston, Mike Devers, Brittany Bowden, Jack Goddard, and Mike Brown.

Meeting conducted by Mayor George A. Anderson.  Mayor Anderson welcomed everyone to the meeting and led those present in the Pledge of Allegiance.   

Approve Minutes of the Council Meeting held on April 27, 2011 

Motion by Rocky Baker to approve the minutes of the April 27, 2011 council meeting as presented.  Second by Joanne Justesen.  Vote:  Cleo Gallegos - Aye; Rocky Baker - Aye; Joanne Justesen - Aye; Leann Smith - Aye.

Discuss/Approve Paying the Bills

Motion by Leann Smith to approve paying the bills as presented.  Second by Rocky Baker.  Vote:  Cleo Gallegos - Aye; Rocky Baker - Aye; Joanne Justesen - Aye; Leann Smith - Aye. 

Discuss/Approve Residential Exchange Program Settlement Agreement with Bonneville Power - Jo Elg

Jo Elg from United Electric Coop explained the revisions to the Residential Exchange Program Settlement Agreement stating that the first proposed REP Settlement Agreement failed to get the required percentages to pass.  The revised agreement changes the required percentages from 91 percent to 75 percent with a due date of June 3, 2011, and changes the date for the administrator to approve from April 25, 2011 to June 6, 2011.

Motion by Rocky Baker to approve the Residential Exchange Program Settlement Agreement with Bonneville Power and authorize the mayoral signature.  Second by Cleo Gallegos.  Roll Call Vote:  Cleo Gallegos - Aye; Rocky Baker - Aye; Joanne Justesen - Aye; Leann Smith - Aye.  

Discuss/Approve Plan of Annexation - Paul Aston

Paul Aston reviewed the City of Heyburn Plan of Annexation.  The plan, which is mandated by the state, addresses the increase in taxes and the services the city would provide.

Motion by Cleo Gallegos to approve the City of Heyburn Plan of Annexation.  Second by Joanne Justesen .  Vote:  Cleo Gallegos - Aye; Rocky Baker - Aye; Joanne Justesen - Aye; Leann Smith - Aye. 

Discuss/Approve Revisions to the Heyburn Employee Handbook

The mayor and council members reviewed the April 21, 2011 draft version of the Employee Handbook. 

Motion by Cleo Gallegos to adopt the revised Heyburn Employee Handbook with adopted date to be changed to May 11, 2011.  Second by Joanne Justesen.  Vote:  Cleo Gallegos - Aye; Rocky Baker - Aye; Joanne Justesen - Aye; Leann Smith - Aye. 

Executive Session for Matters of Litigation as authorized by Idaho Code Section 67-2345

Motion by Leann Smith to go into executive session for matters of litigation as authorized by Idaho Code Section 67-2345.  Second by Rocky Baker.  Roll Call Vote:  Cleo Gallegos - Aye; Rocky Baker - Aye; Joanne Justesen - Aye; Leann Smith - Aye.

Meeting conducted by Mayor Anderson. The topic was a matter of litigation.  This matter was discussed with City Attorney Steven Tuft.  Executive Session began at 7:20 PM and concluded at 8:15 PM.

No decisions were made.   The council meeting ended at 8:15 PM.
