City of Heyburn Council Meeting Minutes
April 27, 2011
7:00 P.M.
Council Present:
Cleo Gallegos, Rocky Baker, Leann Smith, and Joanne Justesen.
Employees Present:

Visitors Present:
Bill and Norma Morrison, Roy Belnap, Paul Aston, Jeremiah Justesen, Jim Powell, Rose Schmitt, Mike Devers, Coreen Hart, Tony Morley, Davis and Karen Vansant, Lucas Handy, and Brittany Bowden.
Meeting conducted by Mayor George A. Anderson. Mayor Anderson welcomed everyone to the meeting and led those present in the Pledge of Allegiance. Mayor Anderson entertained a motion to amend the agenda to include Item No. 9 - Executive Session for Matters of Litigation as authorized by Idaho Code Section 67-2345.

Approve Minutes of the Council Meeting held on April 13, 2011

Discuss Building Code Appeals Board - Tony Morley
Minidoka County Community Development Administrator Tony Morley explained to those present that the Building Code states there must be a Building Code Appeals Board. He asked that the City suggest who would serve on this committee, stating that experience in building would be preferred. City Attorney Steven Tuft asked that a draft procedure of the Building Code Appeals Board be prepared. This item will be back on the City of Heyburn Council Agenda for May 25, 2011.
Discuss/Approve Camp Host Agreement & Contracting with Charles Loveland
City Attorney Steven Tuft reviewed the Camp Host Agreement with the Mayor and council members present.
Motion by Leann Smith to approve the Camp Host Agreement and to contract the 2011 Summer Camp Hosting with Charles Loveland. Second by Rocky Baker. Vote: Cleo Gallegos - Aye; Rocky Baker - Aye; Joanne Justesen - Aye; Leann Smith - Aye.
Discuss/Approve Ordinance No. 536 - Providing for Polling Place and Hours of Election
City Clerk Deborah Hopkins explained the reason for the change in the hours of election was due to the legislative change that now puts the burden of elections on the county clerk. Previously, the City of Heyburn hours of election were 12:00 noon to 8:00 PM. This change would put the hours of election in line with the other elections throughout the county. The new hours of election would be 8:00 AM to 8:00 PM.
Motion by Rocky Baker to have city attorney Steven Tuft read Ordinance No. 536 - Providing for Polling Place and Hours of Election by title only and to suspend the rule for three readings. Second by Cleo Gallegos. Vote: Cleo Gallegos - Aye; Rocky Baker - Aye; Joanne Justesen - Aye; Leann Smith - Aye.
City Attorney Steven Tuft read Ordinance No. 536 by title only.

Discuss/Approve Resolution No. 2011-4 - Adopting an Updated Policy Regarding Public Access to Public Records and Establishing Rates for Locating and Providing Copies of Public Records
City Attorney Steven Tuft stated that he is waiting on more information regarding the actual cost of copies to be added as Exhibit A. The mayor and council members reviewed this resolution and tabled any action until further information is received.
Discuss Operation Facelift and Economic Development Report - Leann Smith
Council President Leann Smith updated those present with Operation Facelift sponsored by Southern Idaho Rural Development. She explained this project is dedicated to improving those areas along the major city routes throughout the Magic Valley area during the week of June 13-18, 2011. Briefly it would require identifying things and places that need to be cleaned up, forming a committee, and seeking donations in both monetary form and in-kind. The theory is to create a better image for prospective businesses looking to relocate in the area. She stated that it is hoped that this will be an ongoing project to be done year after year.
