City of Heyburn Council Meeting Minutes
January 28, 2015
7:00 P.M.

 

Council Present:

Rocky Baker, Dick Galbraith, Dusty Galliher and Cleo Gallegos.

 

Employees Present:

Greg Richins, Dan Bristol, Steven Tuft, and Deborah Hopkins. 

 

Visitors Present:

Ralph Martini, Mike Painter, Jo Elg, Jeremiah Justesen, Rose Schmitt, Bill & Joanne Justesen, Brad Bjerke, Myron Wilson, Mike Yost, Art Walters, Grant & Trevor Schultz, Dallas Duffin,  Dax Duffin, Andrew Deskins, and Jeff McCray.

 

Meeting conducted by Council President Rocky Baker who welcomed everyone to the meeting and then led those present in the Pledge of Allegiance.  

 

Discuss/Approve Minutes of the January 14, 2015 Council Meeting and the January 21, 2015 Special Council Meeting

Motion by Dick Galbraith to approve the minutes of the January 14, 2015 council meeting and the January 21, 2015 special council meeting as presented.  Second by Cleo Gallegos.  Vote:  Rocky Baker – Aye; Cleo Gallegos – Aye; Dick Galbraith – Aye; Dusty Galliher - Aye. 

 

Discuss/Approve Paying the Bills 

Motion by Dick Galbraith to approve the bills as presented.  Second by Dusty Galliher.  Vote:  Rocky Baker – Aye; Cleo Gallegos – Aye; Dick Galbraith – Aye; Dusty Galliher - Aye. 

 

Discuss/Approve Purchase of Conveyor Belt System for WWTP – Ralph Martini

City Wastewater Supervisor Ralph Martini reviewed the options for the purchase of a conveyor belt system for the Wastewater Treatment Plant.  After discussion, it was decided to put this item on the February 11, 2015 city council agenda. 

 

Discuss/Approve Sale of Old Heyburn Elementary School 

Before discussion on this item, Council President Rocky Baker disclosed that Jeff McCray is the Factory Manager at McCain Foods and he felt this relationship would not affect or sway his decision in the sale of the Old Heyburn Elementary School.

 

Councilman Dusty Galliher disclosed that Jeff McCray is his boss at McCain Food and he also felt this relationship would not affect or sway his decision in the sale of the Old Heyburn Elementary School.

 

Councilman Dick Galbraith disclosed that his wife attends The Springs Calvary Chapel, but that he does not.  He also stated that his wife has not been involved with the discussion of the purchase of the Old Heyburn Elementary School.  He stated this relationship has not influenced any decision that he might make.

Motion by Dusty Galliher to approve the Purchase and Sale Agreement of the old Heyburn Elementary School to The Springs Calvary Chapel, Inc. as being in the best interests of the City, for the purchase price of $50,000, as stated in the agreement, with details regarding the fencing to be mutually agreed upon by both parties, and to authorize the Mayor and Clerk to execute the Deed and all other necessary documents to consummate the sale. Second by Dick Galbraith.  Roll Call Vote:  Rocky Baker – Aye; Cleo Gallegos – Aye; Dick Galbraith – Aye; Dusty Galliher - Aye. 

 

Council President Rocky Baker extended a warm welcome on behalf of the City of Heyburn to The Springs Calvary Chapel. 

 

Discussion/Approve Resolution No. 2015-1 Destruction of Records – Deborah Hopkins

City Clerk Deborah Hopkins explained that this resolution is an annual resolution to destroy records that are older than five years and asked for approval.

 

Motion by Dusty Galliher to approve Resolution No. 2015-1 Destruction of Records.  Second by Dick Galbraith.  Vote:  Rocky Baker – Aye; Cleo Gallegos – Aye; Dick Galbraith – Aye; Dusty Galliher - Aye. 

 

Review of Monthly Department Head Reports

The Monthly Department Head Reports were reviewed by those present. 

 

Discuss Pre-Treatment Ordinance

City Attorney Steven Tuft stated a revised draft of the City of Heyburn Pre-Treatment Ordinance will be available for review at the February 11, 2015 city council meeting.

 

Executive Session for Matters of Trade or Commerce and Litigation as per Idaho Code 67-2345 (e) and (f)

Motion by Cleo Gallegos to go into Executive Session for Matters of Trade or Commerce and Litigation as per Idaho Code 67-2345(e) and (f).  Second by Dick Galbraith.  Roll Call Vote:  Rocky Baker – Aye; Cleo Gallegos – Aye; Dick Galbraith – Aye; Dusty Galliher - Aye.

The Executive Session was conducted by Council President Rocky Baker.  The topics were a matter of litigation and a matter of trade or commerce which were discussed with those present.  No decisions were made.  The Executive Session began at 7:47 PM.   Mr. Bjerke was excused from the Executive Session meeting at 8:45 PM.  The Executive Session concluded at 8:52 PM and did not return to open session.
