City of Heyburn Council Meeting & Public Hearing Minutes
February 25, 2015
7:00 P.M.
Council Present:
Rocky Baker, Dick Galbraith, Dusty Galliher and Cleo Gallegos.
Employees Present:
Greg Richins, Dan Bristol, Steven Tuft, and Deborah Hopkins.
Visitors Present:
Alice Hansen, Diane Fluckiger, David Hansen, Braiden Catmull, Russel Mason, Caleb Stapleman, Adrian Barendregt, Faye B. Cole, Ivan McCracken, Karen Pratt, Rose Schmitt, Tom Toronto, Joanne Justesen, Jeremiah Justesen, and Paul Aston.
Meeting conducted by Council President Rocky Baker who welcomed everyone to the meeting including Boy Scout Troop #48. He then led those present in the Pledge of Allegiance.
Discuss/Approve Minutes of the February 11, 2015 Council Meeting
Motion by Cleo Gallegos to approve the minutes of the February 11, 2015 council meeting as presented. Second by Dick Galbraith. Vote: Rocky Baker – Aye; Cleo Gallegos – Aye; Dick Galbraith – Aye; Dusty Galliher - Aye.
Discuss/Approve Paying the Bills
Councilmember Gallegos asked to go on record asking for information on how much money has been spent on the new pickup trucks as well as the police pickup.
Motion by Dick Galbraith to approve the bills as presented. Second by Dusty Galliher. Vote: Rocky Baker – Aye; Cleo Gallegos – Aye; Dick Galbraith – Aye; Dusty Galliher - Aye.
GIS Update – Tom Toronto
Tom Toronto presented a brief update on the progress that has been made on the GIS for the City of Heyburn. Those present thanked him for his informational presentation.
Public Hearing on Elk Meadows PUD Phase 2 – Preliminary Plat
Heyburn Planning and Zoning Administrator Paul Aston stated the Planning and Zoning Commission recommended approval of the preliminary plat. He also stated the Planning and Zoning Commission did note that there was not a designated garbage receptacle area in the preliminary plat.
Rodney Burch presented an overview of the Preliminary Phase 2 Plat that included answering questions and providing information.
Council President Rocky Baker opened the public hearing on the Elk Meadows PUD Phase 2 Preliminary Plat.

Those speaking against the Elk Meadows PUD Phase 2 Preliminary Plat were: Karen Pratt and Faye B. Cole.
Those speaking with comments regarding the Elk Meadows PUD Phase 2 Preliminary Plat were: None.
Hearing no further comments, Council President Rocky Baker closed the public hearing

Discuss/Approve Waiver of Fees for Use of the Riverside Park:
a) Vikingman Triathlon – August 21-22, 2015 - Alice Hansen
Alice Hansen and Diane Fluckiger, representing the Vikingman Triathlon, asked the Heyburn City Council to waive the fees for the use of the Riverside Park for August 21-22, 2015. They also asked the City of Heyburn to provide cones from the Street Department and police for help at the intersection as has been done in the past.
After discussion on this item, no action was taken.
Discuss Ordinance No. 576 – Clarify Procedure for Appointing Officials
City Attorney Steven Tuft explained the purpose of Ordinance No. 576 was to clarifying the procedure for appointing officials and also to make the curfew hours consistent within the City of Heyburn Code Book. He asked the councilmembers to review the draft.
Discuss/Approve Resolution No. 2015-2 – Authorize City Council President to Sign for the Drinking Water Grant
Motion by Dick Galbraith to adopt Resolution No. 2015-2 – Authorize City Council President to Sign for the Drinking Water Grant. Second by Dusty Galliher. Vote: Rocky Baker – Aye; Cleo Gallegos – Aye; Dick Galbraith – Aye; Dusty Galliher - Aye.
Discuss/Approve Ordinance No. 575 – Pretreatment Program
City Superintendent Greg Richins stated the department heads have reviewed the draft of the ordinance. They have provided their concerns and also have questions requiring clarification. It was decided to coordinate a meeting to review the ordinance before bringing the ordinance back to be adopted.

The Monthly Department Head Reports were reviewed by those present.

Motion by Cleo Gallegos to go into Executive Session for Litigation as per Idaho Code 67-2345(a) Personnel, (e) Matters of Commerce, and (f) Litigation. Second by Dick Galbraith. Roll Call Vote: Rocky Baker – Aye; Cleo Gallegos – Aye; Dick Galbraith – Aye; Dusty Galliher - Aye.
Executive Session Minutes

Visitors Present:
None.
The Executive Session was conducted by Council President Rocky Baker. The topics were personnel, matters of commerce, and a matter of litigation which were discussed with those present. No decisions were made. The Executive Session began at 8:40 PM and concluded at 9:05 PM.
The council meeting did not return to open session and adjourned at 9:05 PM.
