City of Heyburn Special Council Meeting Minutes
July 24, 2013

Council Present:
Rocky Baker, Leann Smith, Joanne Justesen and Cleo Gallegos.
Employees Present:
Dan Bristol, Greg Richins, Anson Parke, and Deborah Hopkins.
Visitors Present:
None.
Meeting conducted by Mayor George A. Anderson who welcomed everyone to the meeting.
Budget Work Session
Those present worked on the Street Department budget for FY 2013-14.
Councilmembers expressed their appreciation to Anson Parke for his insight and recommendations on the Street Department budget.
The meeting ended at 7:00 PM.

Kyle Treadway, Matt Carr, William Parsons representing United Electric, Trevor Parke, Rose Schmitt, Les and Cindy Anderson.
Meeting conducted by Mayor George A. Anderson. Mayor Anderson welcomed everyone to the meeting. Mayor Anderson then led those present in the Pledge of Allegiance.
Discuss/Approve Minutes of the July 10, 2013 Special Council Meeting and Regular Council Meeting
Motion by Rocky Baker to approve the minutes of the July 10, 2013 special council meeting and regular council meeting as presented. Second by Joanne Justesen. Vote: Rocky Baker – Aye; Leann Smith – Aye; Cleo Gallegos – Aye; Joanne Justesen - Aye.
Discuss/Approve Paying the Bills
Motion by Rocky Baker to approve paying the bills as presented. Second by Leann Smith. Vote: Rocky Baker – Aye; Leann Smith – Aye; Cleo Gallegos – Aye; Joanne Justesen - Aye.
Discuss/Approve Waiver of Fence on City Easement – Kenworth Sales
Matt Carr, District Manager for Kenworth Sales presented information to those present regarding access to the utilities located inside the proposed fence around the Kenworth Sales property in the Knudsen Industrial Park.
William Parsons, legal representative for United Electric stated United Electric was not willing to have the utility easement locked out.
Executive Session for Matters of Litigation as Per Idaho Code 67-2345 (f) Litigation
Motion by Leann Smith to go into Executive Session as per Idaho Code 67-2345(f) Litigation. Second by Joanne Justesen. Roll Call Vote: Rocky Baker – Aye; Leann Smith – Aye; Cleo Gallegos – Aye; Joanne Justesen - Aye.

Meeting conducted by Mayor George A. Anderson. The topic was a matter of Litigation. This matter was discussed with the mayor, council members, and staff present. Executive Session began at 8:02 PM and concluded at 8:17 PM. No decisions were made.
The council meeting returned to open session where discussion on the access to the public utility easement continued.
Motion by Joanne Justesen to approve the waiver of the fence in the city utility easement provided Kenworth Sales provide access with a key code lock at their expense. Second by Rocky Baker. Roll Call Vote: Rocky Baker – Aye; Leann Smith – Aye; Cleo Gallegos – Nay; Joanne Justesen - Aye.
Discuss/Approve FY 2013-14 Beer & Wine Licenses:
City Clerk Deborah Hopkins reported that the fees have been paid by the following businesses:
Hub Plaza Beer - Off Premise 31.25
Love’s Beer - Off Premise 31.25
Joe’s River Bar Beer - On & Off Premise 125.00
Wine - On Premise 150.00
TAG Inc. (Tony’s) Beer - Off Premise 31.25
Wine - Off Premise 50.00
She stated that Magic Valley Chalet had been contacted regarding the renewal of their beer license. Police Chief Dan Bristol reported there has not been any issues with the businesses.
Motion by Rocky Baker to approve the 2013-14 Beer & Wine Licenses as stated and to also approve the Beer License for Magic Valley Chalet upon receipt of the proper paperwork from the State and County and payment of the City License. Second by Leann Smith. Vote: Rocky Baker – Aye; Leann Smith – Aye; Cleo Gallegos – Nay; Joanne Justesen - Aye.
Review of July, 2013 Monthly Reports
The July, 2013 Monthly Reports were reviewed. Staff present answered questions from the mayor and council members.

Discuss/Approve Backhoe Purchase – Greg Richins
City Superintendent Greg Richins presented information to the council members about purchasing an additional backhoe. Several different options were discussed including the possibility of purchasing the backhoe on a “buy back option”. City Superintendent Richins was asked to get more information regarding the “buy back option” and present it at the next council meeting.
Budget Work Session – Continuation
The mayor, councilmembers, and staff continued to work on the FY 2013-14 budget by reviewing the anticipated expenditures in the General Fund.
