City of Heyburn Council Meeting Minutes

May 22, 2013

7:00 P.M.

 

Council Present:

Rocky Baker, Leann Smith, Joanne Justesen and Cleo Gallegos.   

 

Employees Present:

Greg Richins, Dan Bristol, Steven Tuft and Deborah Hopkins.   

 

Visitors Present: 

Paul Aston, Mike Brown, Amy Despain, Robert Christensen, Laurie Welch, Mark T. Hodge, Lyle Santos, Carlos Lara, Dennis Patterson, Loren West, Mike Tribe, Kelly Anthon.      

 

Meeting conducted by Mayor George A. Anderson.  Mayor Anderson welcomed everyone to the meeting. Mayor Anderson then led those present in the Pledge of Allegiance.   

 

Discuss/Approve Minutes of the May 8, 2013 & May 15, 2013 Special Council Meeting

Motion by Cleo Gallegos to approve the minutes of the May 8, 2013 council meeting and the May 15, 2013 special council meeting.  Second by Joanne Justesen.  Vote:  Rocky Baker – Aye; Leann Smith – Aye; Cleo Gallegos – Aye; Joanne Justesen - Aye. 

 

Discuss/Approve Paying the Bills

Motion by Rocky Baker to approve paying the bills as presented.  Second by Leann Smith.  Vote:  Rocky Baker – Aye; Leann Smith – Aye; Cleo Gallegos – Aye; Joanne Justesen - Aye. 

 

Discuss/Approve Ordinance No. 561 – Changing Reference for Fees to be Charged to Be Set by Resolution – Approve in One Reading

Motion by Leann Smith to have City Attorney Steven Tuft read Ordinance No. 561 by title only and to approve in one reading.  Second by Joanne Justesen.  Vote:  Rocky Baker – Aye; Leann Smith – Aye; Cleo Gallegos – Aye; Joanne Justesen - Aye.

Discuss/Approve Ordinance No. 562 – Zoning Permit Revision – Approve in One Reading

City Attorney Steven Tuft explained this ordinance actually cleans up some of the changes created by the earlier passing of the ordinance pertaining to zoning review.

City Attorney Steven Tuft read Ordinance No. 562 by title only.

Discuss/Approve Resolution No. 2013-7 – Establishing Fees for VIN Inspections and Dog Fees

This item was discussed by those present as the result of the fee schedule proposed by Heyburn Chief of Police Dan Bristol.

 

Motion by Leann Smith to approve Resolution No. 2013-7.  Second by Cleo Gallegos.  Vote:  Rocky Baker – Aye; Leann Smith – Aye; Cleo Gallegos – Aye; Joanne Justesen - Aye. 

 

Discuss/Award Bid for Centennial Drive Refurbish – Greg Richins

City Superintendent Greg Richins reviewed the quotes received for the refurbish of Centennial Drive with those present.  He recommended the job be awarded to Kloepfer, Inc. in the amount of $76,664.45.  He stated Kloefer, Inc. would be able to start on the project right away. 

 

Lyle Santos from Total Waste Management offered suggestions to lower the impact to those businesses that are located within the Centennial Business Park.  His suggestions included doing the repair work at night (after 7:00 PM) and/or doing the work on a weekend when the traffic flows are lighter.  Mayor Anderson thanked him for his comments. 

 

City Superintendent Greg Richins was asked to get additional quotes for the refurbish that would include doing the work at night and/or a weekend.

 

Public Hearing – Ordinance No. 559 – Bulk Storage of Flammable and Combustible Liquids

City Zoning Administrator Paul Aston reviewed Ordinance No. 559 with those present.  He stated this ordinance had been reviewed by the Heyburn Planning & Zoning Commission on May 7, 2013.  Loren West, Chairman of the Planning & Zoning Commission also stated the Planning & Zoning Commission recommended the ordinance be approved.

 

Mayor Anderson opened the public hearing. 

 

Mark T. Hodge asked questions pertaining to the ordinance. 

 

Those speaking in favor of Ordinance No. 559 were:  None. 

 

Those speaking against the passage of Ordinance No. 559 were:  Marvin Christensen

Zoning Administrator Aston, City Superintendent Richins, and Minidoka County Fire Marshall Mike Brown answered questions from the public as well as those from the Heyburn City Council. 

 

There being no other comments, Mayor Anderson closed the public hearing.

The May, 2013 Monthly Reports were reviewed by those present.

Executive Session Minutes.

Council Present:

Rocky Baker, Leann Smith, Joanne Justesen, and Cleo Gallegos.

 

Employees Present:

Steven Tuft, Deborah Hopkins, and Greg Richins.

 

Guests Present:

Kelly Anthon.   

 

The meeting was conducted by Mayor George A. Anderson.  The topics were matters of personnel and matters of trade.  These matters were discussed with the mayor, council members, staff, and guest present.  Executive Session began at 8:24 PM.  The executive session concluded at 9:02 PM.  No decisions were made.  The council meeting returned to open session.

Budget Work Session

Mayor Anderson, council members, and staff members briefly discussed the work sessions for the 2013-14 FY Budget.  It was decided to have Special Council Meetings beginning at 6:00 PM to work on the budget on regular council meeting nights. 

 

The council meeting ended at 9:05 PM.
