City of Heyburn Council Meeting Minutes

March 13, 2013

7:00 P.M.

 

Council Present:

Rocky Baker, Leann Smith, and Cleo Gallegos.  Joanne Justesen – excused.      

 

Employees Present:

Greg Richins, Dan Bristol, Steven Tuft and Deborah Hopkins.   

 

Visitors Present: 

Leisel Snyder and Roy Belnap.

 

Meeting conducted by Mayor George A. Anderson.  Mayor Anderson welcomed everyone to the meeting and led those present in the Pledge of Allegiance.   

 

Approve Minutes of the February 27, 2013 Council Meeting  

Motion by Rocky Baker to approve the minutes of the February 27, 2013 council meeting as presented.  Second by Leann Smith.  Vote:  Rocky Baker – Aye; Leann Smith – Aye; Cleo Gallegos - Abstain. 

 

Discuss/Approve Paying the Bills

Motion by Leann Smith to approve paying the bills as presented.  Second by Rocky Baker.  Vote:  Rocky Baker – Aye; Leann Smith – Aye; Cleo Gallegos - Nay. 

 

Discuss/Approve Waiver of Fees for Use of the Riverside Park

Idaho International Dance Festival

The park reservation form for the Idaho International Dance Festival river party was reviewed by those in attendance. 

 

Motion by Cleo Gallegos to waive the fees for use of the Riverside Park for the river party for the International Dance Festival on Saturday, July 20, 2013.  Second by Leann Smith.  Vote:  Cleo Gallegos – Aye; Rocky Baker – Aye; Leann Smith – Aye.

 

Discuss/Adopt Resolution No. 2013-2 Destruction of Certain Semi-Permanent & Temporary Records – Deborah Hopkins

City Clerk Deborah Hopkins explained this is an annual resolution to destroy records.  As this resolution did not pass last year, it includes records for two years to be destroyed.

 

Motion by Leann Smith to adopt Resolution No. 2013-2 Destruction of Certain Semi-Permanent and Temporary Records.  Second by Rocky Baker.  Vote:  Cleo Gallegos – Aye; Rocky Baker – Aye; Leann Smith – Aye.

 

Discuss/Adopt Resolution No. 2013-3 Condemnation of PR Enterprises 

City Attorney Steven Tuft explained that the City of Heyburn has not been able to reach an agreement with PR Enterprises.  He further explained this resolution allows the city to file the lawsuit.

Motion by Cleo Gallegos to adopt Resolution No. 2013-3 Condemnation of PR Enterprises and authorize the mayoral signature to execute the condemnation complaint.  Second by Rocky Baker.  Roll Call Vote:  Cleo Gallegos – Aye; Rocky Baker – Aye; Leann Smith – Aye.

 

Discuss/Adopt Resolution No. 2013-4 Grant an Access Easement to PR Enterprises

City Attorney Steven Tuft explained that an access easement must be granted and that by state law, you cannot leave a portion of ground land-locked without an access easement. 

 

Motion by Rocky Baker to adopt Resolution No. 2013-4 Grant an Access Easement to PR Enterprises and authorize the mayoral signature to execute the easement.  Second by Cleo Gallegos.  Roll Call Vote:  Cleo Gallegos – Aye; Rocky Baker – Aye; Leann Smith – Aye. 

 

Paul Aston arrived at 7:28 PM. 

 

Executive Session as per Idaho Code 67-2345(f) Litigation

Motion by Leann Smith to go into Executive Session as per Idaho Code 67-2345(f) Litigation.  Second by Cleo Gallegos.  Roll Call Vote:  Rocky Baker – Aye; Leann Smith – Aye; Cleo Gallegos - Aye.

The meeting was conducted by Mayor George A. Anderson.  The topic was litigation.  This matter was discussed with the mayor, council members, and staff present.  Executive Session began at 7:29 PM and concluded at 8:35 PM.  No decisions were made.  The council meeting did not return to open session.
