City of Heyburn Council Meeting Minutes

October 9, 2013

7:00 P.M.

 

Council Present:

Rocky Baker, Leann Smith, Joanne Justesen and Cleo Gallegos.   

 

Employees Present:

Greg Richins, Steven Tuft, Dan Bristol, and Deborah Hopkins 

 

Visitors Present:

Rose Schmitt, Dick Galbraith, Jake Taft, and Jeremiah Justesen.      

 

Meeting conducted by Mayor George A. Anderson who welcomed everyone to the meeting and then led those present in the Pledge of Allegiance.   

 

Mayor Anderson amended the agenda to include:  Economic Development Update – Leann Smith as Item #6B. 

 

Discuss/Approve Minutes of the September 25, 2013 Council Meeting

Motion by Joanne Justesen to approve the minutes of the September 25, 2013 council meeting as presented.  Second by Cleo Gallegos.  Vote:  Rocky Baker – Aye; Leann Smith – Aye; Cleo Gallegos – Aye; Joanne Justesen – Aye.    

 

Discuss/Approve Paying the Bills

Motion by Rocky Baker to approve paying the bills as presented.  Second by Leann Smith.  After discussion, Rocky Baker amended his motion to include paying the bills as presented with the exception of Check #21272 which will be voided and re-issued for the correct amount.  Second by Leann Smith.  Vote:  Rocky Baker – Aye; Leann Smith – Aye; Cleo Gallegos – Aye; Joanne Justesen - Aye.

 

Discuss/Approve Minidoka County Deputizing of Heyburn Police Officers – Minidoka County

Heyburn Police Chief Dan Bristol spoke in favor of having the Heyburn Police Officers be deputized as officers for the Minidoka County Sheriff’s Department.  Heyburn Police Officers Jeremiah Justesen and Jake Taft also spoke in favor of being deputized.  Councilmembers thanked the police officers for sharing their opinions with them.

 

Motion by Cleo Gallegos to approve deputizing Heyburn Police Officers as officers for the Minidoka County Sheriff’s Department.  Second by Leann Smith.  Vote:  Rocky Baker – Aye; Leann Smith – Aye; Cleo Gallegos – Aye; Joanne Justesen - Aye. 

 

Discuss/Approve Ordinance No. 564 – Control & Protection of Easements

Ordinance No. 564 was reviewed by the mayor and councilmembers with discussion centering on Section 2-5-3:  Section B – Penalties and Remedies – Subsection IV in which two options

were presented.  Those options being punishable as a misdemeanor or punishable as an infraction. 

 

Motion by Leann Smith to amend Ordinance No. 564 by changing Section B – Subsection IV to say it is punishable as an infraction.  Second by Rocky Baker.  Vote:  Rocky Baker – Aye; Leann Smith – Aye; Cleo Gallegos – Aye; Joanne Justesen - Aye. 

 

Motion by Leann Smith to have Ordinance No. 564 – Control & Protection of Easements read by title only and approve in one reading.  Second by Rocky Baker.  Vote:  Rocky Baker – Aye; Leann Smith – Aye; Cleo Gallegos – Aye; Joanne Justesen - Aye. 

 

City Attorney Steven Tuft read Ordinance No. 564 by title only.

 

Motion by Rocky Baker to adopt Ordinance No. 564 – Control & Protection of Easements.  Second by Joanne Justesen.  Roll Call Vote:  Rocky Baker – Aye; Leann Smith – Aye; Cleo Gallegos – Aye; Joanne Justesen - Aye. 

 

Discuss/Approve Resolution No. 2013-12 – Repealing Resolution 99-5

City Attorney Steven Tuft stated that Resolution No. 2013-12 was basically a clean-up resolution pertaining to easements. 

 

Motion by Rocky Baker to approve Resolution No. 2013-12 – Repealing Resolution 99-5.  Second by Cleo Gallegos.  Roll Call Vote:  Rocky Baker – Aye; Leann Smith – Aye; Cleo Gallegos – Aye; Joanne Justesen - Aye. 

 

Discuss/Approve Renovations to the Old Heyburn Elementary School

City Superintendent Greg Richins informed those present that he had met with John Gillette regarding the removal of the old white storage building that is located on the old Heyburn Elementary School property.  He stated Mr. Gillette was in agreement with doing the work.

 

This option was discussed by the councilmembers, but no decisions were made.  City Superintendent Greg Richins was asked to check the building for asbestos.  This item will be on the October 23, 2013 city council agenda.

 

Economic Update

Councilwoman Leann Smith provide a brief update on happenings with the Mini-Cassia Economic Development Commission.  She stated the commission has changed their name to Southern Idaho Development and has a new website.  She encouraged those in attendance to visit the website.  In light of recent visitations by prospective businesses visiting the Mini-Cassia area, she also encouraged those present to take a second look at their surroundings to see what visual improvements could be made.  She stated she was in favor of placing a “Welcome to Heyburn” sign at Memorial Park.  Mayor Anderson thanked her for her report.

Executive Session as per Idaho Code 67-2345 (a) and (f) Personnel and Litigation

Motion by Joanne Justesen to go into Executive Session as per Idaho Code 67-2345(a) Personnel and (f) Litigation.  Second by Cleo Gallegos.  Roll Call Vote:  Rocky Baker – Aye; Leann Smith – Aye; Cleo Gallegos – Aye; Joanne Justesen - Aye.

Meeting conducted by Mayor Anderson.  The topics were matters of Litigation and Personnel.  These matters were discussed with the council members and staff present.  Executive Session began at 7:48 PM and concluded at 8:35 PM.  No decisions were made.
