City of Heyburn Council Meeting Minutes
November 13, 2013
7:00 P.M.
Council Present:
Rocky Baker, Joanne Justesen and Cleo Gallegos. Leann Smith – excused.
Employees Present:

Meeting conducted by Mayor George A. Anderson who welcomed everyone to the meeting and then led those present in the Pledge of Allegiance.
Mayor Anderson announced there needs to be a change to the agenda to include Minidoka County Commissioner’s Canvass of Votes.

Discuss/Approve Minutes of the October 23, 2013 Council Meeting and the November 4, 2013 Special Council Meeting
Motion by Joanne Justesen to approve the minutes of the October 23, 2013 council meeting and the November 4, 2013 special council meeting as presented. Second by Rocky Baker. Vote: Rocky Baker – Aye; Cleo Gallegos – Aye; Joanne Justesen – Aye.

Discuss/Approve/Accept the FY 2012-13 Audit – Jeff Poulsen – Evans & Poulsen
Jeff Poulsen from Evans & Poulsen presented the City of Heyburn FY 2012-13 Audit to those present.
Motion by Rocky Baker to accept the FY 2012-13 Audit as presented from Evans & Poulsen. Second by Cleo Gallegos. Vote: Rocky Baker – Aye; Cleo Gallegos – Aye; Joanne Justesen – Aye.
Discuss/Approve Consent to Relocation of Electric Transmission Line – Ralph Williams
City of Heyburn Electric Consultant Ralph Williams informed those present of the need to relocate the transmission line. He explained the line is located in Burley. A request to move the line has been received by the Burley Development Authority, an Urban Renewal Agency of Burley. United Electric has agreed to the move as has the City of Burley. Once the signed agreement has been received by BPA, they will need to approve the move.
Motion by Joanne Justesen to approve the relocation of the electric transmission line and to authorize Mayor Anderson to sign the document. Second by Cleo Gallegos. Vote: Rocky Baker – Aye; Cleo Gallegos – Aye; Joanne Justesen – Aye.
Approve Contract with Cascade Pipeline Corporation for the 18th Street Sewer Main – Greg Richins
City Superintendent Greg Richins stated Cascade Pipeline Corporation is ready to move forward with the 18th Street Sewer Main Project. Before they can do that, a contract needs to be signed with the City of Heyburn.
Motion by Rocky Baker to authorize the mayoral signature on the Cascade Pipeline Corporation Contract for the 18th Street Sewer Main Project. Second by Cleo Gallegos. Vote: Rocky Baker – Aye; Cleo Gallegos – Aye; Joanne Justesen – Aye.
Award Sewer Jet Truck Bid – Greg Richins
City Superintendent Richins reported that one bid had been received for the Sewer Jet Truck from Metroquip in the amount of $362,000.00. He also stated the bid had been reviewed by Ralph Martini.
Motion by Cleo Gallegos to award the Sewer Jet Truck Bid to Metroquip in the amount of $362,000. Second by Rocky Baker. Vote: Rocky Baker – Aye; Cleo Gallegos – Aye; Joanne Justesen – Aye.
Discuss/Approve Renovations to the Old Heyburn Elementary School
John Gillette was asked to present any changes he would like to make to the building in writing. Gillette stated he would like to keep the white building for storage instead of tearing it down. After a lengthy discussion, no decision was made.
Discuss Possible Sub-Lease of Old Heyburn Elementary School with Sharon Mecham
Sharon Mecham would like to sub-lease part of the Old Heyburn Elementary School for the purposes of operating a day care. City Attorney Steven Tuft explained that in order for her to be able to do that, there needs to be a sub-lease agreement with John Gillette and the City of Heyburn before it can go to the Heyburn Planning & Zoning Commission.
City Attorney Steven Tuft was asked to prepare a consent to sub-lease agreement for the next council meeting.
Approve Leaving Deposit with ITD for the 21st Street Project – Greg Richins
City Superintendent Richins informed those present that he has received a request from ITD regarding the $187,000 the City of Heyburn paid last year for the 21st Street Project. As this project is not going to be funded this year, ITD needs to know if the City of Heyburn would like their money to be returned which in all likelihood would need to be paid again in July of 2014, or if the City of Heyburn would like to leave the funds with ITD and let the funds earn interest.
Motion by Cleo Gallegos to leave the $187,000 on deposit with ITD. Second by Rocky Baker. Vote: Rocky Baker – Aye; Cleo Gallegos – Aye; Joanne Justesen – Aye.
