City of Heyburn Council Meeting Minutes

September 25, 2013

7:00 P.M.

 

Council Present:

Rocky Baker, Leann Smith, Joanne Justesen and Cleo Gallegos.   

 

Employees Present:

Greg Richins, Steven Tuft, Dan Bristol, and Deborah Hopkins 

 

Visitors Present:

Rose Schmitt, Mike Devers, Ashlee Langley, Leisel Snyder, Dick & Jody Galbraith, Eric Snarr, Daniel Jensen and John Gillette.     

 

Meeting conducted by Mayor George A. Anderson who welcomed everyone to the meeting and then led those present in the Pledge of Allegiance.   

 

Discuss/Approve Minutes of the September 11, 2013 Council Meeting

Motion by Joanne Justesen to approve the minutes of the September 11, 2013 council meeting as presented.  Second by Cleo Gallegos.  Vote:  Rocky Baker – Aye; Leann Smith – Aye; Cleo Gallegos – Aye; Joanne Justesen – Aye.    

 

Discuss/Approve Paying the Bills

Motion by Leann Smith to approve paying the bills as presented.  Second by Joanne Justesen.  Vote:  Rocky Baker – Aye; Leann Smith – Aye; Cleo Gallegos – Aye; Joanne Justesen - Aye. 

 

Discuss/Approve Minidoka County Deputizing of Heyburn Police Officers – Minidoka County Sheriff Eric Snarr

Minidoka County Sheriff Eric Snarr discussed the possibility of having the Heyburn Police Officers deputized as officers for the Minidoka County Sheriff’s Department.  He answered questions from those present.  City Attorney Steven Tuft recommended waiting until a draft of an agreement is presented before a final decision is made. 

 

Councilwoman Cleo Gallegos stated for the record that she is in support of deputizing Heyburn City Police officers as Minidoka County deputies. 

 

Discuss/Review/Adopt Ordinance No. 564 – Control & Protection of Easements

Motion by Leann Smith to have Ordinance No. 564 – Control & Protection of Easements read by title only and to adopt in one reading with omitting subsection IV under the Penalties and Remedies Section.  Second by Joanne Justesen.  Roll Call Vote:  Rocky Baker – Nay; Leann Smith – Aye; Cleo Gallegos – Aye; Joanne Justesen - Aye. 

 

City Attorney Steven Tuft read Ordinance No. 564 by title only.

Motion by Leann Smith to adopt Ordinance No. 564 – Control and Protection of Easements.   Second by Joanne Justesen.  Roll Call Vote:  Rocky Baker – Nay; Cleo Gallegos – Nay; Joanne Justesen – Aye; Leann Smith – Aye.  Mayor Anderson broke the tie with a “Nay” vote. 

 

Discuss/Approve Resolution No. 2013-12 – Repealing Resolution 99-5

There was no action taken on this item. 

 

Discuss/Approve Renovations to the Old Heyburn Elementary School

City Superintendent Greg Richins informed those present that he had met with Paul Aston to review the old white storage building that is located on the old Heyburn Elementary School property.  He stated in his opinion, the building would be too costly to repair and bring up to code. 

 

Superintendent Richins then discussed another possibility of having the white building demolished with John Gillette doing the work.  This suggestion was discussed among those present.  Superintendent Richins agreed to discuss this possibility with Mr. Gillette and bring this back as an option at the next City Council meeting. 

 

Review of September, 2013 Monthly Department Reports

The September, 2013 Monthly Department Reports were reviewed with those present. 

 

Executive Session as per Idaho Code 67-2345 (a) and (f) Personnel and Litigation

Motion by Rocky Baker to go into Executive Session as per Idaho Code 67-2345(a) and (f) Personnel and Litigation.  Second by Joanne Justesen.  Roll Call Vote:  Rocky Baker – Aye; Leann Smith – Aye; Cleo Gallegos – Aye; Joanne Justesen - Aye.

Guests Present:  None. 

 

Meeting conducted by Mayor Anderson.  The topics were matters of Litigation and Personnel.  These matters were discussed with the council members and staff present.  Executive Session began at 8:07 PM and concluded at 8:20 PM.  No decisions were made. 

 

The council meeting did not return to open session and adjourned at 8:20 PM.
