City of Heyburn Council Meeting Minutes

February 13, 2013

7:00 P.M.

 

Council Present:

Rocky Baker, Cleo Gallegos, and Joanne Justesen.  Leann Smith – excused.      

 

Employees Present:

Greg Richins, Dan Bristol, Steven Tuft and Deborah Hopkins.   

 

Visitors Present: 

Dusty Galliher, Jeff Jensen, Jake Taft, Brenda Bailey, Lamar Bailey, Leisel Snyder, Dustin Richardson, Paul Aston, Gary Schorzman, and Mike Brown.

 

Meeting conducted by Mayor George A. Anderson.  Mayor Anderson welcomed everyone to the meeting and then led those present in the Pledge of Allegiance.   

 

Approve Minutes of the January 23, 2013 Council Meeting and the February 5, 2013 Special Council Meeting   

Motion by Rocky Baker to approve the minutes of the January 23, 2013 council meeting and the February 5, 2013 Special City Council Meeting as presented.  Second by Cleo Gallegos.  Vote:  Cleo Gallegos - Aye; Rocky Baker – Aye; Joanne Justesen – Aye to approve the January 23, 2013 minutes and Nay to approve the February 5, 2013 minutes. 

 

Discuss/Approve Paying the Bills

Motion by Rocky Baker to approve paying the bills as presented.  Second by Joanne Justesen.  Vote:  Cleo Gallegos - Aye; Rocky Baker – Aye; Joanne Justesen – Aye. 

 

Discuss/Approve Payment of Acquisition of Rights of Way for the 21st Street Project

Motion by Rocky Baker to approve the payment of the acquisition of Rights of Way for the 21st Street Project for John and Pamela Ferch in the amount of $9,061.00.  Second by Joanne Justesen. Vote:  Cleo Gallegos – Aye; Rocky Baker – Aye; Joanne Justesen – Aye. 

 

Discuss/Approve Waiver of Fees for Use of the Riverside Park & Amphitheater as Part of the Minidoka County Centennial – Gary Schorzman

Gary Schorzman asked the City Council to waive the fees for use of the Riverside Park and Amphitheater on June 8, 2013 for the purpose of celebrating “The Cities of Heyburn and Emerson” as part of the Minidoka County Centennial.

 

Motion by Cleo Gallegos to waive the fees for the use of the Riverside Park and the Amphitheater on June 8, 2013 as part of the Minidoka County Centennial.   Second by Joanne Justesen.  Vote:  Cleo Gallegos – Aye; Rocky Baker – Aye; Joanne Justesen – Aye. 

 

City Attorney Steven Tuft will verify the insurance coverage by ICRMP.

Discuss/Re-Affirm Clayton King & Brent Tolman to the Heyburn Urban Renewal Agency

Mayor Anderson stated that he had received a request from Ralph Williams, the Heyburn Urban Renewal Agency Chairman stating the terms of Clayton King and Brent Tolman had expired.  Mayor Anderson stated he has agreed with the appointment of these gentlemen to the committee and asked the city council members to affirm his appointment.

 

Motion by Joanne Justesen to reaffirm the appointment of Brent Tolman and Clayton King to the Heyburn Urban Renewal Agency.  Second by Cleo Gallegos.  Vote:  Cleo Gallegos – Aye; Rocky Baker – Aye; Joanne Justesen – Aye. 

 

Councilman Rocky Baker thanked those members of the committee for the job they have done. 

 

Discuss/Approve Purchase of Police Vehicle – Dan Bristol

City of Heyburn Chief of Police Dan Bristol presented the city council members with three separate bids for a pickup to replace the unit that was totaled.  He recommended the pickup be purchased from Dan Wiebold Ford in the amount of $25,957.91.

 

Motion by Rocky Baker to purchase the 2013 Ford F150 4x4 from Dan Wiebold Ford in the amount of $25,957.91.  Second by Cleo Gallegos.   Vote:  Cleo Gallegos – Aye; Rocky Baker – Aye; Joanne Justesen – Aye. 

 

Chief Bristol then introduced Jeff Jensen and Dustin Richardson as new Reserve Officers.  He also congratulated Heyburn Police Officer Jake Taft on his POST Certification. 

 

Discuss/Approve Wheeling Contract with Bureau of Reclamation – Greg Richins

City Attorney Steven Tuft discussed the wheeling contract with the Bureau of Reclamation stating that City of Heyburn Electric Consultant Ralph Williams has reviewed the contract and expressed his approval.

 

Motion by Rocky Baker to approve the Wheeling Contract with the Bureau of Reclamation.  Second by Cleo Gallegos.  Vote:  Cleo Gallegos – Aye; Rocky Baker – Aye; Joanne Justesen – Nay explaining that the information was not in her packet so the opportunity to review was not possible. 

 

Consideration of Proposal to Change Election by Seat – Reference Idaho Code 50-707

The survey from the Heyburn citizens pertaining to election changes was reviewed by those present.  This possible change was discussed with no action taken. 

 

Executive Session as per Idaho Code 67-2345(e) and (f)

Motion by Joanne Justesen to go into Executive Session as per Idaho Code 67-2345(e), and (f).  Second by Cleo Gallegos.  Roll Call Vote:  Cleo Gallegos – Aye; Rocky Baker – Aye; Joanne Justesen – Aye.

Executive Session Minutes.

Council Present:

Cleo Gallegos, Rocky Baker, and Joanne Justesen.

 

Employees Present:

Steven Tuft, Deborah Hopkins, and Greg Richins.

 

Guests Present:

Paul Aston.

 

The meeting was conducted by Mayor George A. Anderson.  The topics were litigation and a matter of acquiring real property.  These matters were discussed with the mayor, council members, and staff present.  Executive Session began at 7:42 PM and concluded at 8:23 PM.  No decisions were made.  The council meeting returned to open session. 

 

Discuss/Approve Revised Annexation Plan for Villa Drive Area

No action was taken on this item. 

 

Discuss/Approve Condemnation Agreement with PR Enterprises, LLC

Motion by Rocky Baker to approve and authorize Mayor Anderson to sign the Condemnation Agreement with PR Enterprises, LLC.  Second by Cleo Gallegos.  Roll Call Vote:  Cleo Gallegos – Aye; Rocky Baker – Aye; Joanne Justesen – Aye.
