City of Heyburn Council Meeting & Public Hearing Minutes

August 28, 2013

7:00 P.M.

 

Council Present:

Rocky Baker, Leann Smith, Joanne Justesen and Cleo Gallegos.   

 

Employees Present:

Dan Bristol, Greg Richins, Steven Tuft, and Deborah Hopkins 

 

Visitors Present:

Lyle Santos, Daniel Jensen, Dusty & Ila Galliher, Leisel Snyder, John Gillette, Dave Pinther, and Eric Snarr.      

 

Meeting conducted by Mayor George A. Anderson.  Mayor Anderson welcomed everyone to the meeting and then led those present in the Pledge of Allegiance.   

 

Mayor Anderson announced the following change to the agenda: 

 

Item #6 – Discuss/Review/Award 18th Street Sewer Main Bid will not be discussed as the recommendation is not ready at this time.  He also stated that the agenda needs to be amended to include as Item #6 – Appointment of Juanita Teeter to the Heyburn Planning & Zoning Commission to take the vacancy created by Brett Thomas.  The reason is that a member needs to be appointed as soon as possible in order that the business of the Heyburn Planning & Zoning Commission can continue without delay. 

 

Mayor Anderson then introduced Minidoka County Sheriff Eric Snarr and his Chief Deputy Dave Pinther.  Both officers took a few minutes to introduce themselves to those present.  Mayor Anderson and the council members thanked both gentlemen for coming to the council meeting. 

 

Discuss/Approve Minutes of the August 14, 2013 Council Meeting

Motion by Joanne Justesen to approve the minutes of the August 14, 2013 council meeting as presented.  Second by Cleo Gallegos.  Vote:  Rocky Baker – Aye; Leann Smith – Aye; Cleo Gallegos – Aye; Joanne Justesen – Aye.    

 

Discuss/Approve Paying the Bills

Motion by Leann Smith to approve paying the bills as presented.  Second by Rocky Baker.  Vote:  Rocky Baker – Aye; Leann Smith – Aye; Cleo Gallegos – Aye; Joanne Justesen - Aye. 

 

Public Hearing on the FY 2013-14 Budget

Mayor Anderson opened the public hearing for the FY 2013-14 budget.

 

Those speaking at the public hearing were:  Dusty Galliher and Lyle Santos.  Both gentlemen spoke but did not have concerns with the FY 2013-14 budget.

  

Daniel Jensen questioned the rise in the spending increase in the Streets and Parks Budget.  His concerns were addressed by those present.

 

Hearing no further comments, Mayor Anderson closed the public hearing. 

 

 

Discuss/Approve the FY 2013-14 Budget

Motion by Cleo Gallegos to approve the FY 2013-14 Budget as presented.  Second by Leann Smith.  Vote:  Rocky Baker – Aye; Leann Smith – Aye; Cleo Gallegos – Aye; Joanne Justesen - Aye. 

 

Discuss/Review Ordinance No. 564 – Control & Protection of Easements

City Attorney Steven Tuft explained that Ordinance No. 564 was presented for discussion and review.  After this discussion and review, City Attorney Tuft was asked to draft a new ordinance for the next council meeting.

 

Discuss/Review/Award 18th Street Sewer Main Bid – Greg Richins

This item was removed from the agenda.  It will be on the September 11, 2013 council meeting agenda.   

 

Confirm the Mayor’s Appointment of Juanita Teeter to the Heyburn Planning & Zoning Commission

Mayor Anderson informed the council members that Juanita Teeter has agreed to serve on the Heyburn Planning & Zoning Commission.  She will take the place of Brett Thomas who is moving out of the area. 

 

Motion by Joanne Justesen to confirm the mayoral appointment of Juanita Teeter to the Heyburn Planning & Zoning Commission.  Second by Cleo Gallegos.  Vote:  Rocky Baker – Aye; Leann Smith – Aye; Cleo Gallegos – Aye; Joanne Justesen - Aye. 

 

Review August, 2013 Monthly Reports

The August, 2013 Monthly Reports were reviewed by the Mayor and council members present.

 

Executive Session as per Idaho Code 67-2345(f) Litigation

Motion by Joanne Justesen to go into Executive Session as per Idaho Code 67-2345(f) Litigation.  Second by Rocky Baker.  Roll Call Vote:  Rocky Baker – Aye; Leann Smith – Aye; Cleo Gallegos – Aye; Joanne Justesen - Aye.

Guests Present:

None.

 

Meeting conducted by Mayor George A. Anderson.  The topic was a matter of Litigation.  This matter was discussed with the mayor, council members, and staff present.  Executive Session began at 8:09 PM and concluded at 8:32 PM.  No decisions were made. 

 

The council meeting did not return to open session and adjourned at 8:32 PM.
