City of Heyburn Council Meeting Minutes

September 11, 2013

7:00 P.M.

Council Present:

Rocky Baker, Leann Smith, Joanne Justesen and Cleo Gallegos.

Mayor George A. Anderson – excused.

Employees Present:

Greg Richins, Steven Tuft, and Deborah Hopkins

Visitors Present:

Rose Schmitt, Dan Sullivan, and John Gillette.

Meeting conducted by Council President Joanne Justesen. Council President Justesen welcomed everyone to the meeting and then led those present in the Pledge of Allegiance.

Discuss/Approve Minutes of the August 28, 2013 Council Meeting

Motion by Leann Smith to approve the minutes of the August 28, 2013 council meeting as presented. Second by Cleo Gallegos. Vote: Rocky Baker – Aye; Leann Smith – Aye; Cleo Gallegos – Aye; Joanne Justesen – Aye.

Discuss/Approve Paying the Bills

Motion by Cleo Gallegos to approve paying the bills as presented. Second by Leann Smith. Vote: Rocky Baker – Aye; Leann Smith – Aye; Cleo Gallegos – Aye; Joanne Justesen - Aye.

Discuss/Review Ordinance No. 564 – Control & Protection of Easements

Ordinance No. 564 was reviewed by those present. This ordinance will be scheduled for the September 25, 2013 city council agenda for possible approval.

Discuss/Review/Award 18^th Street Sewer Main Bid – Greg Richins

City Superintendent Greg Richins recommended the 18^th Street Sewer Main be awarded to Cascade Pipeline Corporation in the amount of $214,590.00.

Motion by Leann Smith to award the 18^th Street Sewer Main to Cascade Pipeline Corporation with Option B in the amount of $214,590. Second by Rocky Baker. Vote: Rocky Baker – Aye; Leann Smith – Aye; Cleo Gallegos – Aye; Joanne Justesen - Aye.

Confirm Hiring of Rosemary Crawford as Deputy City Clerk

Council President Justesen asked the members of the city council to confirm the hiring of Rosemary Crawford as Deputy City Clerk.

Motion by Leann Smith to confirm the hiring of Rosemary Crawford as Deputy City Clerk. Second by Cleo Gallegos. Vote: Rocky Baker – Aye; Leann Smith – Aye; Cleo Gallegos – Aye; Joanne Justesen - Aye.

Discuss/Approve Annual Budget Ordinance No. 565 – Approve in One Reading

Motion by Leann Smith to have Ordinance No. 565 read by title only and to approve the ordinance in one reading. Second by Joanne Justesen. Roll Call Vote: Rocky Baker – Aye; Leann Smith – Aye; Cleo Gallegos – Aye; Joanne Justesen - Aye.

City Clerk Deborah Hopkins read Ordinance No. 565 by title only.

Motion by Cleo Gallegos to adopt Ordinance No. 565 with the suspension of the rule requiring three separate readings and to adopt in one reading. Second by Leann Smith. Roll Call Vote: Rocky Baker – Aye; Leann Smith – Aye; Cleo Gallegos – Aye; Joanne Justesen - Aye.

City Council President Justesen invited audience member Dan Sullivan to address the members of the council. Mr. Sullivan spoke regarding his traffic safety concern at the intersection of 20^th Street and I Street. Those present thanked Mr. Sullivan for taking the time to attend the council meeting and bringing forth his concern.

Executive Session as per Idaho Code 67-2345(f) Litigation

Motion by Rocky Baker to go into Executive Session as per Idaho Code 67-2345(f) Litigation. Second by Cleo Gallegos. Roll Call Vote: Rocky Baker – Aye; Leann Smith – Aye; Cleo Gallegos – Aye; Joanne Justesen - Aye.

Meeting conducted by City Council President Joanne Justesen. The topic was a matter of Litigation. This matter was discussed with the council members and staff present. Executive Session began at 7:38 PM and concluded at 8:16 PM. No decisions were made.

The council meeting did not return to open session and adjourned at 8:16 PM.
