City of Heyburn Council Meeting Minutes
June 23, 2010
7:00 P.M.
Council Present:
Cleo Gallegos, Rocky Baker, Leann Smith, and Joanne Justesen.
Employees Present:
Deb Hopkins, Scott Spevak, and Dan Bristol. Steven Tuft, excused.
Visitors Present:
Jack and Kim Goddard, Rose Schmitt, Dawn Lage, Brenda Bailey, Robyn Andersen, Eva Luna, Bill and Norma Morrison, and Tony Luna.
Meeting conducted by Council President Leann Smith. President Smith welcomed everyone to the meeting. A local Boy Scout Troop led by Randy Okelberry presented the colors and led those in attendance in the Pledge of Allegiance.
Approve Minutes of the Council Meeting on June 9, 2010 and Special Council Meeting on June 14, 2010.
Motion by Cleo Gallegos to approve the June 9, 2010 council meeting and the June 14, 2010 special council meeting minutes as presented. Second by Joanne Justesen. Vote: Cleo Gallegos - Aye; Rocky Baker - Aye; Leann Smith - Aye; Joanne Justesen - Aye.
Discuss/Approve Paying the Bills.
Motion by Joanne Justesen to approve paying the bills as submitted. Second by Rocky Baker. Vote: Cleo Gallegos - Aye; Rocky Baker - Aye; Leann Smith - Aye; Joanne Justesen - Aye.
Discuss/Approve Building Permit Issue - Jack Goddard
Jack Goddard presented photographs and information regarding a building permit issue he has with adding a deck to his property. Council President Leann Smith advised Mr. Goddard to apply for a Variance and go through the Planning and Zoning Commission.
Discuss Ordinance No. 531 - Rezone of the Alfresco Parkway - Second Reading
Council President Leann Smith read Ordinance No. 531 by title only in the absence of City Attorney Steven Tuft.
Discuss/Approve Options for Cleaning up Junk Cars
Fire Chief Mike Brown discussed with the council the problem with contradictory ordinances regard cleaning up junk cars. It was decided to have City Attorney Steven Tuft look at the existing ordinances to see if the conflict can be resolved by combining and creating one ordinance.
Discuss Building Cleaning - Brenda Bailey
Brenda Bailey from Personnel Plus explained to the council members the amount of time and energy that has gone into cleaning City Hall. She asked to continue to clean for one hour a day to keep the building maintenance up. Council members agreed to leave the cleaning at one hour per day. If something requires more time, Brenda Bailey will present the issue to the council and get permission before proceeding with the project.
Declaration of Surplus Property - Scott Spevak
City Superintendent Scott Spevak presented a verbal listing of equipment that needs to be declared Surplus Property. He stated he would present a formal list of equipment to the council members at a later time. Motion by Cleo Gallegos to declare the equipment as surplus and to have Keith Couch sell it at auction. Second by Rocky Baker. Vote: Cleo Gallegos - Aye; Rocky Baker - Aye; Leann Smith - Aye; Joanne Justesen - Aye.
The Boy Scout troop retired the colors.
Executive Session for Matters of Litigation as authorized by Idaho Code Section 67-2345.
Motion by Rocky Baker to go into Executive Session for Matters of Litigation as per Idaho Code Section 67-2345. Second by Cleo Gallegos. Roll Call Vote: Cleo Gallegos, Aye; Rocky Baker, Aye; Leann Smith, Aye; Joanne Justesen, Aye.

Meeting conducted by President Smith. The topic was a litigation issue. Executive Session began at 7:45 PM and concluded at 8:41 PM.
No decisions were made.
Budget Work Session
City council members and staff reviewed the budget items as submitted by Heyburn Police Chief Dan Bristol.
The council meeting ended at 9:40 PM.
