Visitors Present:
Mike Devers, Eric Johnson, and Mike Brown.
Meeting conducted by Mayor George A. Anderson. Mayor Anderson welcomed everyone to the meeting.
Work Session for the purpose of reviewing/revising the Employee Handbook
Mayor Anderson, council members and employees present reviewed the draft of the Employee Handbook.

Approve Minutes of the Special Council Meeting and Regular Council Meeting on December 8, 2010
Motion by Leann Smith to approve the minutes of the December 8, 2010 special and regular council meeting. Second by Joanne Justesen. Vote: Cleo Gallegos - Aye; Rocky Baker - Aye; Joanne Justesen - Aye; Leann Smith - Aye.
Discuss/Approve Paying the Bills
Motion by Leann Smith to approve paying the bills as presented. Second by Rocky Baker. Vote: Cleo Gallegos - Aye; Rocky Baker - Aye; Joanne Justesen - Aye; Leann Smith - Aye.
Public Hearing for Lebsack Preliminary Subdivision Plat & Rezone and possible approval
Norma Morrison, newly elected Chairman of the Heyburn Planning and Zoning Commission reported on the findings of their meeting held on December 13, 2010. She stated the recommendation of the commission was to approve both the preliminary subdivision plat and the rezone.
Paul Aston reported that a pre-construction meeting had already been held with discussion centering on what would be needed for the subdivision. He stated that no annexation would be necessary as the property is already within the city limits of Heyburn. Additionally, he stated that at some point maintenance of the 300 South road and the 600 West road may be an issue as both roads are half in the city limits and half in the county.
Ken Lebsack spoke on the business that is contemplating building in the area. He stated they are looking at building on Lot 4 with the potential of hiring 70-100 employees.
Mayor Anderson opened the public hearing for the Lebsack Preliminary Subdivision Plat & Rezone.
David Price spoke in favor of the project. Mr. Price thanked the Heyburn City Council members for their foresight.
No one spoke against the project.
Hearing no further comments, Mayor Anderson closed the public hearing.
Motion by Rocky Baker to approve the Lebsack Preliminary Subdivision Plat and authorize an ordinance for the zoning change be drafted. Second by Cleo Gallegos. Roll Call Vote: Cleo Gallegos - Aye; Rocky Baker - Aye; Joanne Justesen - Aye; Leann Smith - Aye.
Discuss/Approve Ordinance No. 535 - Moratorium on Overhead Fuel Storage Tanks
Motion by Cleo Gallegos to have City Attorney Steven Tuft read Ordinance No. 535 - Moratorium on Overhead Fuel Storage Tanks by title only and approve with one reading. Second by Joanne Justesen. Vote: Cleo Gallegos - Aye; Rocky Baker - Aye; Joanne Justesen - Aye; Leann Smith - Aye.
Motion by Leann Smith to approve Ordinance No. 535 - Moratorium on Overhead Fuel Storage Tanks suspending the rule of three readings. Second by: Rocky Baker. Roll Call Vote: Cleo Gallegos - Aye; Rocky Baker - Aye; Joanne Justesen - Aye; Leann Smith - Aye.
Discuss Resolution on Designating Who is Responsible for Enforcement of Building Codes
City Attorney Steven Tuft stated that because the City of Heyburn currently has a contract in place with Minidoka County, that agreement will remain in place until it has been replaced.
Continued work on the Employee Handbook as needed
Mayor Anderson, council members, and staff present continued to work on revisions to the Employee Handbook.
City council meeting ended at 8:30 PM.
