December 12, 2007

7:00 P.M.

 

Council Present:

Cleo Gallegos, Dee Ray Bailey, Rocky Baker and Leann Smith.

Employees Present:

Linda Dayley and Scott Spevak. Steve Tuft excused.

Visitors Present: George Warrell, Rod and Rose Schmitt, Sven Berg, Paul Aston, Bill and Norma Morrison.

 

Meeting conducted by Mayor George A. Anderson.

 

Pledge of Allegiance led by Mayor Anderson.

 

Mayor Anderson amended the agenda to include an Executive Session for Matters of Commerce.

 

Approve Minutes of the Council Meeting on November 28, 2007.

Motion by Rocky Baker to approve the minutes for the Council Meeting on November 28, 2007 as written. Second by Cleo Gallegos. Vote: Cleo Gallegos - Aye; Dee Ray Bailey - Aye; Rocky Baker - Aye; Leann Smith - Aye.

 

Approve paying the Bills.

Motion by Rocky Baker to pay the bills. Second by Dee Ray Bailey. Vote: Cleo Gallegos - Aye; Dee Ray Bailey - Aye; Rocky Baker - Aye; Leann Smith - Aye.

 

Approve Ordinance No. 503 - 2006 Edition of the International Building Codes.

Ordinance No. 503 - 2006 Edition of the International Building Code Updates.

 

Paul Aston from Planning and Zoning explained that the building codes are published in two year cycles.

 

After discussion Leann Smith made a motion to read Ordinance No. 503 by title only suspending the rule of three readings. Second by Dee Ray Bailey. Roll Call Vote: Cleo Gallegos - Aye; Dee Ray Bailey - Aye; Rocky Baker - Aye; Leann Smith - Aye.

 

Mayor George A. Anderson read Ordinance 503 by title only.

 

Motion by Dee Ray Bailey to approve Ordinance No. 503 - 2006 Edition of the International Building Codes. Second by Rocky Baker. Vote: Cleo Gallegos - Aye; Dee Ray Bailey - Aye; Rocky Baker - Aye; Leann Smith - Aye.

 

Approve Resolution No. 2007-11 - Records Destruction.

RESOLUTION OF THE CITY OF HEYBURN PROVIDING FOR AND AUTHORIZING THE DESTRUCTION OF CERTAIN SEMIPERMANENT AND TEMPORARY RECORDS.

 

City Clerk Linda Dayley explained to the Mayor and Council that the list of records to be destroyed was sent to State Archivist Steve Walker from the Idaho State Historical Society. Steve replied to the request stating that the Historical Society did not consider the records on the list to have historical significance giving his approval as State Archivist for the destruction of the list of records.

 

Motion by Dee Ray Bailey to approve Resolution No. 2007-11 authorizing the destruction of the listed simipermanent and temporary records. Second by Leann Smith. Vote: Cleo Gallegos - Aye; Dee Ray Bailey - Aye; Rocky Baker - Aye; Leann Smith - Aye.

 

Mayor Time.

Rod Schmitt: How the records were destroyed? City Clerk explained that the records are burned.

 

Rod Schmitt: Why does the International Building Code make you run galvanized pipe under the footing of your structure that eventually rusts out?

Scott Spevak replied that if you use galvanized, as a sleeve and use PVC pipe inside,

 it won’t rust out.

 

Rod Schmitt: What does it mean executive session for matters of commerce?

Mayor Anderson replied there are three reasons for going into executive session and that no executive session may be held for the purpose of taking any final action or making any final decision:

 

Matters of commerce are to conduct deliberations concerning labor negotiations or to acquire an interest in real property. To consider preliminary negotiations involving matters of trade or commerce in which the governing body is in competition with governing bodies and to consider records that are exempt from disclosure.

 

Employee: When hiring a public officer, employee, staff member or individual agent. To consider the evaluation, dismissal or disciplining of, or to hear complaints or charges brought against, a public officer, employee or staff member.

 

Litigation: To consider and advise its legal representatives in pending litigation or where there is a general public awareness of probable litigation.

 

Mayor Anderson reminded everyone that the Council Meeting for December 26, 2007 is cancelled.

 

Executive Session for Matters of Commerce.

Motion by Rocky Baker for an Executive Session for Matters of Commerce as authorized by Idaho Code Section 67-2345. Second Cleo Gallegos. Roll Call Vote: Cleo Gallegos - Aye; Dee Ray Bailey - Aye; Rocky Baker - Aye; Leann Smith - Aye.

 

 Council Meeting adjourned to Executive Session at 7:30 P.M.

 

Executive Session Minutes.

Council Present:

Employees Present:

Scott Spevak and Linda Dayley.

 

The executive session commenced at 7:34 P.M. and ended at 7:47 P.M. The executive session consisted of a discussion of confidential matters of commerce. No decisions were made.
