Employees Present:
Linda Dayley, Scott Spevak, Earl Andrew and Mike Brown.
Visitors Present: Karen Rehn and Gene Holm.
Meeting conducted by Mayor George A. Anderson.
Pledge of Allegiance led by Mayor Anderson.
Mayor Anderson amended the agenda to include an Executive Session for litigation and to table items 3 and 4.
Approve Minutes of the Council Meeting on July 11, 2007.
Motion by Rocky Baker to approve the minutes of the Council Meeting on July 11, 2007 as written. Second by Dee Ray Bailey. Vote: Cleo Gallegos - Aye; Dee Ray Bailey - Aye; Leann Smith - Aye; Rocky Baker - Aye.
Approve paying the bills.
Motion by Rocky Baker to approve paying the bills for the month as written. Second by Dee Ray Bailey. Vote: Cleo Gallegos - Aye; Dee Ray Bailey - Aye; Leann Smith - Aye; Rocky Baker - Aye.
Discuss/Approve Ordinance No. 498.
AN ORDINANCE OF THE CITY OF HEYBURN, IDAHO AMENDING TITLE 5 CHAPTER 5 OF THE HEYBURN CODE, ADOPTING NEW PROVISIONS CODIFIED AS SECTIONS 5-5-9 THROUGH 5-5-14; PROVIDING FOR POLICIES AS TO TOPPING OF PUBLIC TREES; LICENSING OF TREE SERVICE COMPANIES FOR WORK ON PUBLIC TREES; PROVIDING FOR RESTRICTIONS ON DIGGING NEAR PUBLIC TREES; PROVIDING FOR A LISTING OF PROHIBITED PUBLIC TREES; AND, PROVIDING A LISTING OF TREES COMPATIBLE FOR PUBLIC USE; PROVIDING THAT VIOLATION OF SECTIONS 5-5-9, 5-5-10 AND 5-5-11 SHALL BE A MISDEMEANOR; PROVIDING FOR ADOPTION WITH ONLY ONE READING; AND, PROVIDING FOR EFFECTIVE DATE.
After discussion Council tabled Ordinance No. 498 until August 8, 2007 meeting. Earl Andrew will have Steve Tuft make changes to the ordinance.
Approve Beer and Wine License for August 1, 2007 thru July 31, 2008.
Mayor and Council discussed the five Beer and or Wine Licenses applied for, which were in their packets. The businesses are Tag Inc. Tony’s, Joe’s River Bar, Hub Plaza, Love’s Travel Stop and The Pub.
Motion by Rocky Baker to approve the Beer and or Wine License for the five businesses and to exclude Taco Jalisco. Second by Dee Ray Bailey. Vote: Cleo Gallegos - Aye; Dee Ray Bailey - Aye; Leann Smith - Aye; Rocky Baker - Aye.
Accept Sealed Bids for Surplus Items.
City Superintendent Scott Spevak informed the Mayor and Council that the sealed bids for the auction were opened on July 13, 2007. The high bidders were Stan Tate on the Jeep Cherokee ($75.), 1989 Chevrolet 1500 Pickup ($538.) and the Water Truck ($711.). George Warrell on the 1989 Ford 150 Pickup ($100.00). No bids on the 1999 Ford 4 door Crown Victoria and the Van Guard Mechanical Sweeper.
Motion by Leann Smith to accept the high bids on the auctioned equipment. Second by Rocky Baker. Vote: Cleo Gallegos - Aye; Dee Ray Bailey - Aye; Leann Smith - Aye; Rocky Baker - Aye.
Budget Workshop.
Budget Workshop discussion.
Motion by Dee Ray Bailey to adopt and have evaluation forms completed once a year and have them available for council by June 1st of each year for budgeting purposes. Second by Leann Smith. Vote: Cleo Gallegos - Aye; Dee Ray Bailey - Aye; Leann Smith - Aye; Rocky Baker - Aye.
Motion by Dee Ray Bailey to give a 3% raise to most employees and accept the budget up to this point. Second by Cleo Gallegos. Roll Call Vote: Cleo Gallegos - Aye; Rocky Baker - Nay; Leann Smith - Aye; Dee Ray Bailey - Aye.
Executive Session for Litigation.
Motion by Rocky Baker for an Executive Session for Matters of Litigation as authorized by Idaho Code Section 67-2345 . Second by Cleo Gallegos. Roll Call Vote: Cleo Gallegos - Aye; Dee Ray Bailey - Aye; Leann Smith - Aye; Rocky Baker - Aye.
Council Meeting adjourned to Executive Session at 8:30 P.M.

The executive session commenced at 8:31 P.M. and ended at 8:50 P.M. The executive session consisted of a discussion of confidential litigation matters.
