November 14, 2007

Council Present:

Cleo Gallegos, Dee Ray Bailey, Rocky Baker and Leann Smith.

Employees Present:

Linda Dayley, Mike Brown and Steve Tuft. Scott Spevak excused.

Visitors Present: George Warrell, Rose Schmitt, Jeff Poulsen and Rich Greene.

 

Meeting conducted by Mayor George A. Anderson.

 

Pledge of Allegiance led by Mayor Anderson.

 

Approve Minutes of the Council Meeting on October 24, 2007.

Motion by Dee Ray Bailey to approve the minutes of the Council Meeting on October 24, 2007 as written. Second by Leann Smith. Vote: Cleo Gallegos - Aye; Dee Ray Bailey - Aye; Rocky Baker - Aye; Leann Smith - Aye.

 

Approve Minutes of the Special Council Meeting on November 7, 2007.

Motion by Rocky Baker to approve the minutes of the Special Council Meeting to ratify the election votes on November 7, 2007 as written. Second by Cleo Gallegos. Vote: Cleo Gallegos - Aye; Dee Ray Bailey - Aye; Rocky Baker - Aye; Leann Smith - Aye.

 

Approve Paying the Bills except the Bailey Oil Bill.

Motion by Dee Ray Bailey to pay the bills except the Bailey Oil Bill. Second by Leann Smith . Vote: Cleo Gallegos - Aye; Dee Ray Bailey - Aye; Rocky Baker - Aye; Leann Smith - Aye.

 

Approve Paying the Bailey Oil Bill.

Motion by Leann Smith to pay the Bailey Oil Bill. Second by Cleo Gallegos. Roll Call Vote: Cleo Gallegos - Aye; Dee Ray Bailey - Abstained; Rocky Baker - Aye; Leann Smith - Aye.

 

Discuss/Accept Audit for Fiscal Year 2006-2007 - Jeff Poulsen, Evans & Poulsen.

Jeff Poulsen from Evans and Poulsen presented a summary of the audit for the City of Heyburn to the Mayor and Council members, stating the city was in good financial condition.

 

Motion by Leann Smith to accept the 2006-2007 audit as presented. Second by Cleo Gallegos. Vote: Cleo Gallegos - Aye; Dee Ray Bailey - Aye; Rocky Baker - Aye; Leann Smith - Aye.

 

Motion by DeeRay Bailey to retain Evans and Poulsen for 2007-2008. Second by Rocky Baker. Vote: Cleo Gallegos - Aye; Dee Ray Bailey - Aye; Rocky Baker - Aye; Leann Smith - Aye.

Discuss/Approve Consent from the City of Heyburn to the Minidoka County School District for Use of the Public Right-of-Way to Lay Irrigation Lines for the New Heyburn School.

Attorney Steve Tuft sent a letter to Michael Tribe, Minidoka School District’s attorney, explaining that an easement is not needed, but rather consent of the City for use of the public right of way by the School District to lay the irrigation lines and as of yet there has been no reply. This item tabled until a later date.

 

Discuss/Approve McBride II Subdivision Amended Developer’s Agreement.

Agreement between the City of Heyburn, Idaho, of P.O. Box 147, Heyburn, Idaho 83336, hereinafter referred to as City; and, Roger McBride, whose address is P.O. Box 358, Heyburn, Idaho 83336, acting through his attorney in fact, Teesa Sinclair, of 2155 Elsie Avenue, Heyburn, Idaho 93336, hereinafter referred to as Developer.

 

Motion by Rocky Baker to approve the McBride II amended Developer’s Agreement and authorization the mayoral signature. Second by Dee Ray Bailey. Roll Call Vote: Cleo Gallegos - Aye; Dee Ray Bailey - Aye; Rocky Baker - Aye; Leann Smith - Aye.

 

Discuss/Approve the Burch Petition and Request for Annexation and for Zoning of Land to be Annexed.

Attorney Steve Tuft sent a draft of the petition and request for annexation and for zoning of land to be annexed but has received no response. This item was tabled until a later date.

Executive Session for Litigation and Matters of Commerce.

Motion by Dee Ray Bailey for an Executive Session for Litigation and Matters of Commerce as authorized by Idaho Code Section 67-2345. Second by Rocky Baker. Roll Call Vote: Cleo Gallegos - Aye; Dee Ray Bailey - Aye; Rocky Baker - Aye; Leann Smith - Aye.

 

 Council Meeting adjourned to Executive Session at 7:29 P.M.

 

Executive Session Minutes.

The executive session commenced at 7:30 P.M. and ended at 8:05 P.M. The executive session consisted of a discussion of confidential litigation and matters of commerce.
