Public Hearing on the Annexation of Property East of Villa
October 24, 2007
7:00 P.M.
Council Present:
Cleo Gallegos, Dee Ray Bailey, Rocky Baker and Leann Smith.
Employees Present:

Meeting conducted by Mayor George A. Anderson.
Pledge of Allegiance led by Mayor Anderson.
Mayor Anderson amended the agenda to postpone the Public Hearing for the annexation of property east of Villa for sometime in January 2008. The McBride Subdivision Agreement was also postponed.
Approve Minutes of the Council Meeting on October 10, 2007.
Motion by Dee Ray Bailey to approve the minutes of the Council Meeting on October 10, 2007 as written. Second by Rocky Baker. Vote: Cleo Gallegos - Aye; Dee Ray Bailey - Aye; Rocky Baker - Aye; Leann Smith - Aye.
Approve Paying the Bills.
Motion by Rocky Baker to pay the bills. Second by Cleo Gallegos. Vote: Cleo Gallegos - Aye; Dee Ray Bailey - Aye; Rocky Baker - Aye; Leann Smith - Aye.
Public Hearing for the Annexation of Property East of Villa.
Mayor Anderson announced that the Public Hearings for the annexation of property east of Villa Drive are now moved to sometime after the first of January 2008.
Discuss/Approve Vacating the Irrigation Easement for the New Heyburn School.
Dr. Scott Rogers updated the Mayor and Council on the construction of the new schools in Minidoka County. He explained to the Mayor and Council that the School District would like for the City of Heyburn to vacate an irrigation easement, 20 feet in width, across a portion of fourth street lying between Block 217 and Block 219, as shown on the Official Plat of the Heyburn Town site dated January, 1954. The irrigation easement area contains 1600 square feet, more or less.
After discussion, attorney Steve Tuft suggested that he would contact the Minidoka County School District’s attorney and then bring it back to council to the Mayor and Council for discussion or approval.
Dr. Rogers also discussed the possible donation of the old Heyburn Elementary School, on the north side of 17th Street, to the City of Heyburn. The School Board of Trustees need to have some direction from the Mayor and Council.
Discuss/Approve McBride II Subdivision Agreement.
Agreement between the City of Heyburn, Idaho, of P.O. Box 147, Heyburn, Idaho 83336, hereinafter referred to as City; Roger McBride, whose address is P.O. Box 358, Heyburn, Idaho 83336, both hereinafter referred to as Developer, and Herb Sinclair and Teesa Sinclair, husband and wife, 2155 Elsie Avenue, Heyburn, Idaho 93336, as owners.
This item was postponed until a later date.
Mayor Time.
Discussion on the misconception of the water bond election. The bond would authorize the city to seek financing at a lower rate to pay for a new well. City taxes will not be raised because of the water bond. The water utility increase had to be raised to meet criteria relating to obtain lower financing rates. If the bond does not pass the city can seek judicial recourse. If that fails, the city would be unable to finance the well and would have to accumulate enough extra revenue to pay for a new well. But if infrastructure increases in future years as dramatically as they have in the recent past, it could be years before Heyburn would have enough saved to pay for a new well. Pressure in Heyburn’s water system is already low in some areas of the city. After the school is built and a new housing complex connects to the water system, pressure may drop below minimum requirements for the fire department flow.

Motion by Dee Ray Bailey for an Executive Session for Litigation and Matters of Commerce as authorized by Idaho Code Section 67-2345. Second by Leann Smith. Roll Call Vote: Cleo Gallegos - Aye; Dee Ray Bailey - Aye; Rocky Baker - Aye; Leann Smith - Aye.

The executive session commenced at 7:35 P.M. and ended at 7:55 P.M. The executive session consisted of a discussion of confidential litigation and matters of commerce.
