Mayor: Mayor Cleo Gallegos.

 

Council Present: Rocky Baker, Dick Galbraith, Dusty Galliher, and Joanne Justesen.

 

Employees Present:

Dan Bristol, Anson Parke, Eric Christensen, Michael Tribe, and Ashlee Langley. Greg Richins – excused.

           

Visitors Present:

Rose Schmitt, Paul Aston, Dalles Duffin, Brent Smith, Jo Elg, Leann Smith, Rodney Cottom, and Brenda Cottom.

 

Meeting conducted by Mayor Cleo Gallegos who welcomed everyone to the meeting.

 

Welcome & Pledge

Mayor Gallegos asked City Resident Leann Smith to lead those present in the Pledge of Allegiance.

 

Discuss/Approve Minutes of the August 24, 2016 Council Meeting & Public Hearing

Motion by Joanne Justesen to approve the minutes of August 24, 2016 Council Meeting & Public Hearing as presented.  Second by Rocky Baker.  Roll-Call Vote:  Rocky Baker – Aye; Dick Galbraith – Aye; Dusty Galliher - Aye; Joanne Justesen – Aye.

 

Discuss/Approve Paying the Bills

Motion by Dick Galbraith to approve the bills as presented.  Second by Joanne Justesen. Roll-Call Vote:  Rocky Baker – Aye; Dick Galbraith – Aye; Dusty Galliher - Aye; Joanne Justesen – Aye.

 

Discuss/Approve or Decline Offer of Terrorism Additional Coverage

City Clerk Ashlee Langley stated the City of Heyburn needs to either accept or decline the Terrorism Coverage as offered by ICRMP at an additional insurance premium amount of $18,024.

 

Motion by Rocky Baker to decline the Terrorism Coverage offered by ICRMP and to authorize the Mayor’s signature.  Second by Dick Galbraith. Roll-Call Vote:  Rocky Baker – Aye; Dick Galbraith – Aye; Dusty Galliher - Aye; Joanne Justesen – Aye.

 

Discuss/Approve/Adopt Ordinance No. 16-584 – Annual Appropriation Ordinance

Motion by Dick Galbraith to read Ordinance No. 16-584 – Annual Appropriation Ordinance by title only for its first and only reading.  Second by Joanne Justesen. Roll-Call Vote:  Rocky Baker – Aye; Dick Galbraith – Aye; Dusty Galliher - Aye; Joanne Justesen – Aye.

           

City Attorney Michael Tribe read Ordinance No. 16-584 by title only.

Discuss/Approve Ordinance No. 16-585 – Public Assemblies Ordinance - First Reading

City Attorney Michael Tribe presented Ordinance No. 16-585.

 

After discussion, this item was tabled.

           

Public Hearing for Application for Subdivision Submitted by B.E. Smith Investments

Paul Aston representing Brent Smith & Dalles Duffin presented the Application for Subdivision Submitted by B.E. Smith Investments for the intended purpose of creating 4 lot residential Subdivision.

 

Planning & Zoning Administrator Tony Morley wasn’t able to attend the meeting but has provided staff notes pertaining to the Subdivision Submitted by B.E. Smith Investments for the city council to read.

 

Mayor Gallegos opened the public hearing.

 

Those speaking in favor of the Subdivision Application were: Leann Smith and Brenda Cottom.

 

Those speaking against the Subdivision Application were: None.

 

Those speaking neither against nor in favor of the Subdivision Application were: None. 

 

Hearing no public comments, Mayor Gallegos closed the public hearing.  

 

Discuss/Approve Application for Subdivision Submitted by B.E. Smith Investments

After discussion, this item was tabled for further negotiations between the City and Developer.

 

Motion by Dick Galbraith to continue the Public Hearing for the Subdivision Application Submitted by B.E. Smith Investments at the October 26, 2016 Council Meeting.  Second by Dusty Galliher.  Roll-Call Vote:  Rocky Baker – Aye; Dick Galbraith – Aye; Dusty Galliher - Aye; Joanne Justesen – Aye.

 

Discuss/Approve 21st Street Change Order #13 – Irrigation Line

Robert Ramsey from Civil Science presented 21st Street Change Order #13 for irrigation line improvement.

 

Motion by Rocky Baker to approve 21st Street Change Order #13 for irrigation line adjustment.  Second by Dick Galbraith.  Roll-Call Vote:  Rocky Baker – Aye; Dick Galbraith – Aye; Dusty Galliher - Aye; Joanne Justesen – Aye.

 

Mayor’s Time

Councilmember Rocky Baker gave a brief update on the Animal Control Board. Mr. Baker stated that 142 dogs have been taken to the shelter for the current fiscal year. Those present thanked him for the update.

 

Councilmember Dusty Galliher gave a brief update on the Mini-Cassia Airport Committee. Those present thanked him for the update.

 

Mayor Gallegos stated that Ryan Moyle would like to donate a sign to the City of Heyburn. Mayor asked council members for suggestions as to what kind of sign they would like to see.

Executive Session

Pursuant to Idaho Code 74-206 (a)to consider hiring a public officer, employee, staff member or individual agent, wherein the respective qualities of individuals are to be evaluated in order to fill a particular vacancy or need. This paragraph does not apply to filling a vacancy in an elective office or deliberations about staffing needs in general; (f) to communicate with legal counsel for the public agency to discuss the legal ramifications of and legal options for pending litigation, or controversies not yet being litigated but imminently likely to be litigated. The mere presence of legal counsel at an executive session does not satisfy this requirement.

 

Motion by Joanne Justesen to go into Executive Session as per Idaho Code 74-206 (1) (a) personnel and (f) litigation.  Second by Dick Galbraith. Roll-Call Vote:  Rocky Baker – Aye; Dick Galbraith – Aye; Dusty Galliher - Aye; Joanne Justesen – Aye.
