November 9, 2016 Council Meeting Minutes
Mayor: Mayor Cleo Gallegos.
Council Present: Rocky Baker, Dick Galbraith, Dusty Galliher, and Joanne Justesen.
Employees Present:
Reed Cotten, Eric Christensen, Dan Bristol, and Ashlee Langley. Greg Richins – excused.
Visitors Present:

Meeting conducted by Mayor Cleo Gallegos who welcomed everyone to the meeting.
Welcome & Pledge
Mayor Gallegos welcomed those present to the meeting. Mayor Gallegos announced that Attorney Reed Cotten is representing Robinson & Tribe this evening in place of City Attorney Michael Tribe. Those present thanked Mr. Cotten for his attendance.
Mayor Gallegos asked Attorney Reed Cotten to lead those present in the Pledge of Allegiance.
Discuss/Approve Minutes of the October 26, 2016 Council Meeting & Continuation of Public Hearing
Motion by Joanne Justesen to approve the minutes of October 26, 2016 Council Meeting & Public Hearing as presented. Second by Rocky Baker. Roll-Call Vote: Rocky Baker – Aye; Dick Galbraith – Aye; Dusty Galliher - Aye; Joanne Justesen – Aye.
Discuss/Approve Paying the Bills

Discuss/Approve Possibly Cancelling the November 23, 2016 Council Meeting &
the December 28, 2016 Council Meeting
Motion by Dusty Galliher to approve cancelling the November 23, 2016 Council Meeting but to keep the regularly scheduled meeting for December 28, 2016. Second by Joanne Justesen. Roll-Call Vote: Rocky Baker – Aye; Dick Galbraith – Aye; Dusty Galliher - Aye; Joanne Justesen – Aye.
Discuss/Approve/Accept the FY 2015-16 Audit – Jeff Poulsen – Evans, Poulsen & Catmull
Jeff Poulsen from Evans, Poulsen & Catmull presented the City of Heyburn FY 2015-16 Audit to those present.
Motion by Rocky Baker to accept the FY 2015-16 Audit as presented from Evans, Poulsen & Catmull with the understanding that Evans, Poulsen & Catmull will perform next year’s audit as well. Discuss/Approve Sign Donation - Moyle Holdings, LLC
Mayor Gallegos stated that she has met with Ryan Moyle regarding the sign donation. Mr. Moyle plans to donate a rock with “Welcome to Heyburn” and the city logo. Mayor Gallegos recommended the council approve the sign donation.

Discuss/Approve Memorandum of Understanding with Moyle Holdings, LLC
City Clerk Ashlee Langley presented the Memorandum of Understanding with Moyle Holdings, LLC. Mrs. Langley stated that this MOU is for the property adjacent to 21st Street that Moyle has deeded to the City. Rather than receiving financial compensation, Moyle has agreed to certain provisions regarding landscaping, installation and maintenance of an irrigation system and delivery of water to the irrigation system. This agreement provides for the terms and conditions between Moyle’s and the City.
After discussion, this item was tabled for clarification on fencing mentioned in the agreement.
Discuss/Approve LDS Pole Relocation – Right of Entry Agreement
Attorney Reed Cotten representing Robinson & Tribe presented the LDS Right of Entry Agreement to those present. Mr. Cotten stated that this agreement gives the City one-time access to go in and move poles. The right of entry will expire within six months or at the completion of the project whichever is sooner. Mr. Cotten recommended council approval.

Discuss/Approve Ordinance No. 16-585 Summary - Mass Gatherings
City Clerk Ashlee Langley presented the Summary of Ordinance No. 16-585 to those present. Mrs. Langley explained the Ordinance Summary was created to cut down on publication costs to the City.

Mayor’s Time
Mayor Gallegos asked the council members when they would like to start setting up Special Meetings to discuss the Cities rate structures and various other budget related items that need addressed.
Council members decided to schedule the first Special Meeting for January 11, 2017 at 5:30 PM.
Councilman Rocky Baker stated that the next Animal Board Meeting is scheduled for
February 7, 2017.
