City of Heyburn Council Work Meeting Minutes
June 05, 2018
3:45 P.M.

 

 

Mayor: Mayor Cleo Gallegos.

 

Council Present: Dick Galbraith, Joanne Justesen, and Rose Schmitt.

 

Employees Present:

Tony Morley, and Charity Salazar.

 

Paul Ross joined the meeting at 3:55 PM.

 

Mayor Cleo Gallegos excused Chad Anderson from the meeting.

 

Discussion Regarding Public Outreach

City Administrator Tony Morley provided the city council with proposed public outreach dates for Water and Wastewater Bonds. Mr. Morley suggested sending out flyers, notice on billings, and to set out notices on the front counter at City Hall, whatever we can do to notify the public on these meetings. City Council discussed how important it is that the council be present and very versed on what we our asking and talking about.  It was suggested that the city also publish in the local newspapers.

 

Update on Bonding for Wastewater & Water
City Administrator Tony Morley provided those present with an update on the Wastewater and Water Bonds. Mr. Morley stated he has been in contact with bond counsel, Zions Public Finance, Region IV Development, Corps of Engineers, and Jeff Poulsen, the City’s Accountant to put together a strategy plan for moving forward.

 

Those present thanked Mr. Morley for the update.

 

Discuss / Approve Heyburn Safe Routes to School Construction Administration Agreement - ACTION   ITEM

City Administrator Tony Morley stated that he has been in contact with Civil Science, Inc. regarding the Heyburn Safe Routes to School Construction Administration Agreement. Mr. Morley stated that they have been in negotiations regarding the price on the contract. Mr. Morley stated he has received an agreement at a substantially lower cost.  

 

Jake Southwick, Project Engineer for Civil Science spoke in regards to the agreement stating that if the city authorized a preconstruction contract it would cut down the cost substantially.

 

Motion by Dick Galbraith to approve the Heyburn Safe Routes to School Construction Administration Agreement as presented authorizing the Mayors signature.  Second by Joanne Justesen.  Roll-Call Vote: Dick Galbraith – Aye; Joanne Justesen – Aye; Rose Schmitt – Aye.

 

Discuss / Approve Advanced Metering Infrastructure Agreement with Sensus USA Inc.

– ACTION ITEM

Those present discussed concerns with the contract presented. This item was tabled for further information.

 

Discuss / Approve FY 2018-19 Budget Work Meeting Schedule – ACTION ITEM

City Administrator Tony Morley provided those present with a schedule for meetings to work on the 2018-19 Fiscal Year budget.

 

Motion by Joanne Justesen to approve the FY 2018-19 Budget Work Meeting Schedule as presented.  Second by Rose Schmitt.  Roll-Call Vote:  Dick Galbraith – Aye; Joanne Justesen – Aye; Rose Schmitt – Aye.

 

Discuss / Approve R & M Steel Bid for the Purchase of the Street Department Building

– ACTION ITEM

City Administrator stated that the city council approved a quote at the May 23, 2018 City Council meeting that was more than 90 days old, so the purchase price has increased to 137,400 with time and materials not to exceed $5,000. Mr. Morley stated the commitment letter and a check for 20% down has been processed and is awaiting council approval before it’s released.

 

Motion by Dick Galbraith to approve the R & M Steel Bid in the amount of $137,400, with time and materials not to exceed $5,000 for the Purchase of the Street Department Building.  Second by Joanne Justesen.  Roll-Call Vote:   Dick Galbraith – Aye; Joanne Justesen – Aye; Rose Schmitt – Aye.

 

Training on ex parte contacts and investigations

City Attorney Paul Ross provided those present with training on ex parte contacts and investigations. Mr. Ross explained the difference between quasi-judicial and legislative functions of the city. Mr. Ross explained that quasi-judicial is a proceeding conducted by an administrative body that is similar to a court proceeding. Mr. Ross explained that legislative functions would consist of policy or code changes, or setting budgets.

 

Those present thanked Mr. Ross for the training.
