Mayor: Mayor Cleo Gallegos.

 

Council Present: Chad Anderson, Dick Galbraith, Joanne Justesen, and Rose Schmitt.

 

Welcome & Pledge

Meeting conducted by Mayor Cleo Gallegos who welcomed everyone to the meeting.

 

Mayor Gallegos asked Wayne Schenk to lead those present in the Pledge of Allegiance.

 

Discuss/Approve Minutes of the January 10, 2018 Council Meeting

Motion by Joanne Justesen to approve the minutes of the January 10, 2018 Council Meeting as presented. Second by Dick Galbraith. Roll-Call Vote:   Chad Anderson – Aye; Dick Galbraith – Aye; Joanne Justesen – Aye; Rose Schmitt – Aye.

 

Discuss/Approve Paying the Bills

Motion by Dick Galbraith to approve the bills as presented.  Second by Joanne Justesen. Roll-Call Vote:   Chad Anderson – Aye; Dick Galbraith – Aye; Joanne Justesen – Aye; Rose Schmitt – Aye.

 

Discuss / Approve New Customer Portal Access and Use Agreement Contract No. 18BS-10652 with Bonneville Power Administration

Jo Elg, General Manager for United Electric presented the New Customer Portal Access and Use Agreement with Bonneville Power Administration to those present. Jo Elg explained that the new agreement will replace and supersede the previous agreement that was signed in 2011. The new agreement provides clarification of the roles and responsibilities of all parties who access the Customer Portal, and allows for different access permission to be granted to individual users, and includes cyber security measures that align with the Federal Information Security Management Act. Jo Elg recommended the council approve the new Customer Portal Access Agreement.

 

Motion by Dick Galbraith to approve New Customer Portal Access and Use Agreement Contract No. 18BS-10652 with Bonneville Power Administrationas presented and authorize the Mayors signature.  Second by Joanne Justesen. Discuss / Adopt Resolution No. 2018-1 Retaining Luke Marchant of Holden, Kidwell, Hahn & Crapo, P.L.L.C and Christopher H. Meyer of Givens Pursley LLP for Outside Water Counsel

RESOLUTION NO. 2018-1
RESOLUTION OF THE CITY OF HEYBURN APPOINTING ADDITIONAL LEGAL COUNSEL, DEFINING THE SCOPE OF REPRESENTATION OF ADDITIONAL COUNSEL, AND DETERMINING THE METHOD OF COMPENSATION.

 

City Attorney Paul Ross informed those present that both parties have agreed to cooperate and be efficient in the use of time. Mr. Ross stated the resolution is for book keeping and formal documentation that the two firms represent the City as legal counsel.

 

Motion by Dick Galbraith to adopt Resolution No. 2018-1 Retaining Luke Marchant of Holden, Kidwell, Hahn & Crapo, P.L.L.C and Christopher H. Meyer of Givens Pursley LLP for Outside Water Counsel and authorize the Mayors signature.  Second by Chad Anderson. Discuss / Approve Salvage Yard License Application and Transfer of Fee for United Metals, LLC

City Attorney Paul Ross explained the Salvage Yard License Application and Transfer of Fee for United Metals, LLC to those present. Mr. Ross stated this is for the property formerly known as Gibson Truck & Auto located at 1840 Highway 30. Mr. Gibson renewed his license in December for the 2018 year and one of the conditions on the sale of the property was the transfer of license. Mr. Ross explained that because it expressly states on our license that it is not transferable, tonight there is a new application, but the fee for 2018 has already been paid to the City. Mr. Ross stated that the applicant is requesting that the fee paid for the 2018 year be transferred to them.

 

Motion by Joanne Justesen to approve Salvage Yard License Application and Transfer of Fee for United Metals, LLC as presented.  Second by Chad Anderson.  Roll-Call Vote:   Chad Anderson – Aye; Dick Galbraith – Aye; Joanne Justesen – Aye; Rose Schmitt – Aye.

 

Discuss / Approve Sweep Account with First Federal Bank

Mayor Cleo Gallegos asked the council to table this item stating that First Federal Bank has asked for additional time to gather information to bring before the city council.

 

This item was tabled.

 

Discuss / Approve Re-appointment of Scot Bell to the Planning & Zoning Committee

Mayor Cleo Gallegos stated that City Administrator Tony Morley has been in contact with Scot Bell and he has accepted an additional term to the Planning & Zoning Commission.

 

Motion by Dick Galbraith to approve the re-appointment of Scot Bell to the Planning & Zoning Commission.  Second by Joanne Justesen.  Roll-Call Vote:   Chad Anderson – Aye; Dick Galbraith – Aye; Joanne Justesen – Aye; Rose Schmitt – Aye.

 

Discuss / Approve 2018 - 1st Quarter Treasurers Financial Report

Those present reviewed the 2018 1st Quarter Treasurers Financial Report.

 

Motion by Joanne Justesen to approve the 2018 1st Quarter Treasurers Financial Report as presented.  Second by Dick Galbraith.  Roll-Call Vote:   Chad Anderson – Aye; Dick Galbraith – Aye; Joanne Justesen – Aye; Rose Schmitt – Aye.

 

Review January 2018 Monthly Department Head Reports

Those present reviewed the January 2018 Monthly Department Head Reports.

 

Mayors Time & Committee Reports

Councilwoman Joanne Justesen provided those present with an update on the Joint Powers Animal Control board stating that Monday the Minidoka County Commissioners chose three trustees for the Gellings trust. Those trustees are Jim Bowers, Jeff McEwen, and Maureen Newton. Councilwoman Joanne Justesen informed those present that the next meeting is scheduled for January 30, 2018 and she will bring a report back to the council after the meeting.

 

Mayor Gallegos turned the time over to councilman Chad Anderson to present an idea to those present.

 

Councilman Chad Anderson stated that he has put together a committee to sponsor an event in October at the Heyburn Riverside Park. The purpose of the event is to give back to the residents of Heyburn and those in the surrounding areas. Mr. Anderson stated that the committee plans to partner up with the Mini-Cassia Women’s Shelter. This event would include activities for the kids, free prizes, picture booths, straw maze, free car seat checks, food vendors and live entertainment. Mr. Anderson stated that they have been successful in getting grants and donations to fund the event. The event is set for Saturday, October 6, 2018.

 

Mayor Gallegos commended Chad Anderson for taking such an event on and encouraged everyone to attend.

 

Mayor Gallegos took a moment to present the possibility of holding monthly work sessions with the city council in addition to the regular council meetings. Mayor Gallegos explained that these meetings would be open to the public, but no decisions would be made. Mayor Gallegos asked the council to consider the work sessions. Mayor Gallegos hopes to start the work sessions in March.

Executive Session

Pursuant to Idaho Code 74-206(1)(c)  To acquire an interest in real property which is not owned by a public agency; and (f) to communicate with legal counsel for the public agency to discuss the legal ramifications of and legal options for pending litigation, or controversies not yet being litigated but imminently likely to be litigated. The mere presence of legal counsel at an executive session does not satisfy this requirement.

 

Motion by Chad Anderson to go into Executive Session as per Idaho Code 74-206 (1)(c) and (f) for possible real estate acquisition and litigation.  Second by Dick Galbraith.  Roll-Call Vote:   Chad Anderson – Aye; Dick Galbraith – Aye; Joanne Justesen – Aye; Rose Schmitt – Aye.

 

Executive Session started at 7:40 PM and returned to open meeting at 9:06 PM.
