Notice of Public Hearing - The Underdog Property Annexation & Zoning 071922

NOTICE OF PUBLIC HEARING

HEYBURN PLANNING AND ZONING COMMISSION will hold a public hearing on Tuesday 19 July 2022 at 4:00 PM in the City Council Chambers located at 941 18th Street, Heyburn, Idaho to hear public comment on the following application.  HEYBURN CITY COUNCIL will hold a public hearing on Wednesday 27 July 2022 at 7:00 PM in the same location to hear public comment on the following application and P&Z Commission’s recommendations.

ANNEXATION AND ZONING pursuant to Idaho Code 50-222 and 67-6511 of property belonging to Underdog Enterprises LLC, contiguous to the City of Heyburn.  

               The Underdog property, RP10S23E116405, open field located north and west of the Wren property, 382 West 400 South, Heyburn, Idaho, known by the legal description:

Township 10 South, Range 23 East, Boise Meridian, Minidoka County, Idaho

Section 11: A portion of SW Quarter more particularly described below.

Commencing at the SW corner of Section 11 marked by a 5/8” rebar, Thence along the south line of the SW quarter North 89°56’01” East 486.50 feet to a 1/2" rebar and the TRUE POINT OF BEGINNING.

Thence North 0°07’33” East 453.88 feet to a 1/2" rebar;

Thence South 76°13’24” East 11.98 feet to a 1/2" rebar on the west line of Lot 3, Block 4 of the Midway Subdivision (vacated);

Thence South 76°14’38” East 162.15 feet to a 1/2” rebar;

Thence South 0°45’51” East 103.10 feet to a 1/2" rebar;

Thence North 89°14’09” East 220.70 feet to a 1/2" rebar;

Thence North 0°44’30” West 198.10 feet to a 1/2" rebar;

Thence North 76°15’02” East 161.26 feet to a 1/2" rebar;

Thence South 0°38’02” East 172.95 feet to a 1/2" rebar;

Thence South 25°18’51” West 25.11 feet to a 1/2" rebar;

Thence South 57°52’20” West 138.44 feet to a 1/2" rebar;

Thence South 67°52’36” West 88.75 feet to a 1/2” rebar;

Thence South 87°32’01” West 304.24 feet to a 1/2” rebar;

Thence South 0°01’46” West 232.92 feet to the south line of the SW quarter;

Thence along said south line South 89°56’01” West 30.08 feet to the TRUE POINT OF BEGINNING.

The lands of Underdog contains 2.02 acres.

This property is currently zoned by Minidoka County as Commercial General and the City proposes the zoning be the same after annexation.

A copy of the proposed Ordinance, Annexation Plan, and maps are available for review and inspection at the City Clerk’s office at City Hall, Heyburn, Idaho or by request by e-mail to tmorley@heyburncity.org or dencinas@heyburncity.org  A copy of the Annexation Plan is attached to this notice when mailed. 

The public is invited to attend and give comment regarding this proposed action at either or both hearings.  Written comments will be accepted at the office of Heyburn City Clerk until 4:00 PM on 14 July 2022 and placed into the record and heard by the P&Z Commission and City Council at both meetings.  Submission can be by drop off of documents, fax (208) 679-2438, or e-mail (as listed above).
