Notice of Public Hearing - Higley Properties Annexation & Zoning 111522

NOTICE OF PUBLIC HEARING

HEYBURN PLANNING AND ZONING COMMISSION will hold a public hearing on Tuesday 15 November 2022 at 4:00 PM in the City Council Chambers located at 941 18th Street, Heyburn, Idaho to hear public comment on the following application.

ANNEXATION AND ZONING pursuant to Idaho Code 50-222 and 67-6511 of properties belonging to Rex Higley and Eric Higley, contiguous to the City of Heyburn.   City also seeks comments on renaming 600 West Road, not part of Highway 27, to Nevada Avenue; renaming 300 South Road to 35th Street; and renumbering parcels on both roads (this applies only to parcels within city limits).

           1.          The Rex Higley properties, RP10S23E059080, RP10S23E059090, and RP10S23E059540, located at 295 South 600 West, Heyburn, Idaho, and the Eric Higley property, RP10S23E059530, located at 604 West 300 South, Heyburn, Idaho, are all known by the legal description:

Township 10 South, Range 23 East, Boise Meridian, Minidoka County, Idaho

Section 4:  A portion of the SW Quarter of the SW Quarter and Section 5:  A portion of the SE Quarter of the SE Quarter more particularly described as follows:

Beginning at the SE corner of the SE Quarter of the SE Quarter of Section 5 monumented by an aluminum cap perpetuated December 14, 1998, as Instrument No. 438735, Minidoka County records and thence along the south line thereof South 89°45’57” West 298.92 feet to the west boundary of the Lands of Eric Higley;

Thence along the west boundary of the Lands of Eric and Rex Higley North 0°12’18” West 388.50 feet to the north boundary of the Lands of Rex Higley;

Thence along said north boundary extended to the east right-of-way of State Highway 27 North 89°45’57” East 358.92 feet;

Thence along said east right-of-way South 0°12’18” East 98.44 feet to the south boundary of the Martsch Subdivision;

Thence along said south boundary North 89°42’24” East 130.00 feet;

Thence South 0°12’18” East 20.00 feet to the north boundary of the Lands of Stevo’s L.L.C.;

Thence along said north boundary South 89°42’24” West 130.00 feet to the east right-of-way of State Highway 27;

Thence along said right-of-way South 0°12’18” East 270.00 feet to the south line of the SW Quarter of the SW Quarter of Section 4;

Thence along said south line South 89°42’24” West 60.00 feet to the True Point of Beginning.

These properties are currently zoned by Minidoka County as Commercial General and the city solicits proposals for zoning of the land after annexation.

The public is invited to attend and give comment regarding this proposed action.  Written comments will be accepted at the office of Heyburn City Clerk until 4:00 PM on 10 November 2022 and placed into the record and heard by the P&Z Commission at the date of the meeting.  Submission can be by drop off of documents, fax (208) 679-2438, or e-mail (as listed above).

P&Z Commission recommendations for Annexation and Zoning, if any, may be submitted to the HEYBURN CITY COUNCIL for a public meeting on 30 November 2022 at 7:00 PM at the same location.
