City of Heyburn Council Meeting Minutes

October 10, 2012

7:00 P.M.

 

Council Present:

Rocky Baker, Cleo Gallegos, Joanne Justesen and Leann Smith.   

 

Employees Present:

Greg Richins, Dan Bristol, Steven Tuft, Mike Brown and Dee Ann South.  Deborah Hopkins excused.     

 

Visitors Present: 

Leisel Snyder, John Gillette, Andrew Gillette, Debbie Henscheid, Davis & Karen Vansant, Anna & Jeff McEwen, Rose Schmitt.

 

Meeting conducted by Mayor George A. Anderson.  Mayor Anderson then led those present in the Pledge of Allegiance.   

 

Mayor Anderson asked for a motion to amend the agenda to include the following:  Discuss/Approveto proceed withthe Riverton Substation Regulator Addition as submitted by Trevor Parke from United Electric.

 

Motion by Rocky Baker to amend the agenda to include proceeding with the Riverton Substation Regulator Addition as proposed by Trevor Parke from United Electric.  Second by Joanne Justesen.  Vote:  Cleo Gallegos - Aye; Rocky Baker – Aye; Leann Smith – Aye; Joanne Justesen - Aye.  

 

Approve Minutes of the September 26, 2012 Council Meeting   

Motion by Joanne Justesen to approve the minutes of the September 26, 2012 council meeting as presented.  Second by Cleo Gallegos.  Vote:  Cleo Gallegos - Aye; Rocky Baker – Aye; Leann Smith – Aye; Joanne Justesen - Aye.   

 

Discuss/Approve Paying the Bills

Motion by Leann Smith  to approve paying the bills as presented.  Second by Rocky Baker.  Vote:  Cleo Gallegos - Aye; Leann Smith - Aye; Rocky Baker – Aye; Joanne Justesen - Aye. 

 

Discuss/Approve Declaring October as Domestic Violence Awareness Month – Debbie Henscheid

Debbie Henscheid, board member of the Mini-Cassia Shelter – “Haven of Hope” asked the mayor and council to declare October, 2012 as Domestic Violence Awareness Month.

 

She also presented information on an upcoming event called “Walk a Mile in Her Shoes” to be held on Saturday, October 13, 2012 on the Rupert Square.  She encouraged everyone to come out to support this great cause.

 

Motion by Rocky Baker to declare October, 2012 as Domestic Violence Awareness Month.  Second by Cleo Gallegos.  Vote:  Cleo Gallegos - Aye; Leann Smith - Aye; Rocky Baker – Aye; Joanne Justesen - Aye.

 

Update on Amphitheater Committee – Joanne Justesen

Councilwoman Joanne Justesen presented an update on the Heyburn Amphitheater Committee stating that she had attended one meeting in which the committee had reviewed and made suggestions to the draft of the park ordinance.  She stated the committee is very willing and open to suggestions and ideas. The committee is going to meet again later in the month to review the revisions made to the draft of the ordinance.

 

Discuss/Approve Ordinance No. 557 – Zoning Review Prior to Issuance of a Building Permit - First Reading

City Attorney Steven Tuft briefly outlined the reasons for Ordinance No. 557.  He stated that this ordinance has been reviewed by Minidoka County officials, City Superintendent Greg Richins, and Heyburn Planning & Zoning Administrator Paul Aston. 

 

Motion by Leann Smith to have City Attorney Steven Tuft read Ordinance No. 557 by title only for the first reading.  Second by Joanne Justesen.  Vote:  Cleo Gallegos - Aye; Leann Smith - Aye; Rocky Baker – Aye; Joanne Justesen - Aye.

Overhead Storage Tank Recommendation from Minidoka County Fire Protection District Chief Mike Brown - Tabled

 

Discuss/Approve to proceed with the Riverton Substation Regulator Addition.

Superintendent Greg Richins provided council members with the proposal from Powers Engineers for the Riverton Substation Regulator Addition. Trevor Parke from United Electric has been working with Power Engineers to design a structure for Voltage /Regulators in the Riverton Substation. Mr. Parke also provided an estimated cost break down.

 

Motion by Leann Smith to approve the proposal submitted by Power Engineers and to begin the project for the Voltage Regulators in the Riverton Subdivision. Second by Cleo Gallegos. Vote:  Cleo Gallegos – Aye; Leann Smith – Aye; Joanne Justesen – Aye; Rocky Baker – Aye. 

 

Discuss/Approve Aerial Photography Expenditure – Greg Richins

City Superintendent Greg Richins presented more detailed information regarding the proposed aerial photography quote. He discussed the benefits of having aerial photographs of the City. He also presented information pertaining to the ownership of the final product and how it could be used.

 

Motion by Leann Smith to approve the Aerial Photography expenditure as submitted by Brian Rieter at a cost of $11,722.00  with payment for this project to be split between the different departments.  Second by Rocky Baker.  Vote:  Cleo Gallegos – Aye; Leann Smith – Aye; Joanne Justesen – Aye; Rocky Baker – Aye. 

 

Discuss Social Media Policy

The different types of social media were discussed with those present with additional input from Heyburn Police Chief Dan Bristol and City Superintendent Greg Richins.

 

After an extended discussion it was decided that a committee, which will include Chief Dan Bristol, Councilwoman Joanne Justesen and others to be appointed by Superintendent Greg Richins, would gather more information and make recommendations as to what should be in the policy and how it should be put into place. The committee will report back at the November 14, 2012 city council meeting.

 

Discuss/Approve Termination of Amended Agreement Regarding Joint Use of Fire Chief Between the City of Heyburn and the Minidoka County Fire District

Motion by Cleo Gallegos to approve the termination of the Amended Agreement Regarding Joint Use of the Fire Chief between the City of Heyburn and the Minidoka County Fire District effective December 31, 2012.  Second by Leann Smith.  Roll Call Vote:  Cleo Gallegos - Aye; Leann Smith - Aye; Rocky Baker – Abstain; Joanne Justesen - Aye.  

 

Discuss/Approve Revision No. 1 to Exhibit A Customer Portal Administrators and Authorized Third Parties Agreement, Contract No. 11BS-10364 – BPA

Motion by Leann Smith to authorize the mayoral signature on the BPA Contract No. 11BS-10364.  Second by Rocky Baker.  Roll Call Vote:  Cleo Gallegos – Aye; Rocky Baker – Aye; Joanne Justesen – Aye; Leann Smith – Aye.

 

Executive Session for Purposes of Litigation as Per Idaho Code 67-2345(f)

Motion by Joanne Justesen to go into executive session for matters of litigation as per Idaho Code 67-2345(f).  Second by Cleo Gallegos.  Roll Call Vote:  Cleo Gallegos – Aye; Rocky Baker – Aye; Joanne Justesen – Aye; Leann Smith – Aye.

Meeting conducted by Mayor George A. Anderson.  The topic was a matter of litigation.  This matter was discussed with the mayor, council members, and staff present.  Executive Session began at 8:00 PM.  The executive session concluded at 8:15  PM.  No decisions were made.

 

The council meeting did not return to open session and ended at 8:15  PM.
