City of Heyburn Council Meeting Minutes and Public Hearing
August 22, 2012
7:00 P.M.
Council Present:
Rocky Baker, Cleo Gallegos, Joanne Justesen and Leann Smith.
Employees Present:
Greg Richins, Dan Bristol, and Deborah Hopkins. Steven Tuft – excused.
Visitors Present:
Laurie Welch, Ralph Williams, and Leisel Snyder.
Meeting conducted by Mayor George A. Anderson. Mayor Anderson then led those present in the Pledge of Allegiance.
Approve Minutes of the August 8, 2012 Special Council Meeting and the August 8, 2012 Council Meeting
Motion by Joanne Justesen to approve the minutes of the August 8, 2012 special council meeting, and the August 8, 2012 council meeting as presented. Second by Cleo Gallegos. Vote: Cleo Gallegos - Aye; Rocky Baker – Aye; Leann Smith – Aye; Joanne Justesen - Aye.
Discuss/Approve Paying the Bills
Motion by Cleo Gallegos to approve paying the bills as presented. Second by Leann Smith. Vote: Cleo Gallegos - Aye; Leann Smith - Aye; Rocky Baker – Aye; Joanne Justesen - Aye.
Discuss/Approve Loan to the Heyburn Urban Renewal Agency to Pay Bills
Ralph Williams, Chairman of the Heyburn Urban Renewal Agency answered questions from the councilmembers regarding the URA bills. Councilwoman Leann Smith asked Mr. Williams to convey the appreciation of the council to the committee for the important job they do.
Motion by Leann Smith to approve the loan to the Heyburn Urban Renewal Agency to pay the bills as follows: Elam & Burke $3,949.50 and Harlan Mann $1,357.33 for a total of $5,306.83. Second by Cleo Gallegos. Vote: Cleo Gallegos – Aye; Leann Smith – Aye; Rocky Baker – Aye; Joanne Justesen – Aye.
Discuss/Approve Letter of Support to the Boise Housing Corporation – Jim Tomlinson
There was no representation from the Boise Housing Corporation present at the meeting.
Public Hearing on the FY 2012-13 Budget
Mayor Anderson opened the public hearing on the FY 2012-13 budget.
There were no public comments. Hearing no comments, Mayor Anderson closed the public hearing.

Discuss/Approve the FY 2012-13 Budget
Motion by Leann Smith to approve the FY 2012-13 Budget. Second by Cleo Gallegos. Roll Call Vote: Cleo Gallegos – Aye; Leann Smith – Aye; Joanne Justesen – Aye; - Rocky Baker – Nay.
Discuss/Approve Revised Agreement with PSI, Inc.
City Superintendent Greg Richins reported that he had been in contact with Josh Brown from PSI, Inc. who is currently out of town. Mr. Brown indicated he would be available Monday to sign the Revised Agreement.
Motion by Leann Smith to approve the Revised Agreement with PSI, Inc. Second by Joanne Justesen. Vote: Cleo Gallegos – Aye; Leann Smith – Aye; Joanne Justesen – Aye; - Rocky Baker – Nay.
Discuss/Approve Commercial Garbage Hauling Licenses
Motion by Cleo Gallegos to approve the Commercial Garbage Hauling Licenses for PSI, Inc. and Western Waste Services. Second by Joanne Justesen. Vote: Cleo Gallegos – Aye; Leann Smith – Aye; Joanne Justesen – Aye; - Rocky Baker – Nay.
Discuss/Approve Ordinance No. 551 – Use of City Parks – For review purposes only
Ordinance No. 551 was presented for review purposes only. Council members felt the document was lengthy and complicated and suggested that perhaps a simpler ordinance could be written. This item will be on the agenda at the next council meeting for further review.
Appoint Member of City Council to be Liaison to the Heyburn Amphitheatre Committee
Mayor Anderson stated that he felt the best person to be a liaison to the Heyburn Amphitheatre Committee was Councilwoman Joanne Justesen. The council members were all in agreement. Mayor Anderson thanked Councilwoman Justesen for accepting this appointment.
Discuss/Approve Ordinance No. 553 – Amending Code 3-6-6 Modifying Type and Size of Garbage Containers – First Reading
Motion by Cleo Gallegos to have Mayor Anderson read Ordinance No. 553 – Amending Code 3-6-6 Modifying Type and Size of Garbage Containers by title only for the first reading. Second by Joanne Justesen. Roll Call Vote: Cleo Gallegos – Aye; Leann Smith – Aye; Joanne Justesen – Aye; Rocky Baker – Aye.
Mayor Anderson read Ordinance No. 553 by title only for the first reading.
Discuss/Approve Ordinance No. 554 – Junkyard Licenses to be Approved by the City Council – First Reading
Mayor Anderson explained this ordinance would move the approval of Junkyard Licenses to the City Council with the City Clerk issuing the licenses after council approval.

Discuss/Approve Purchase of Sander – Greg Richins
City Superintendent Greg Richins reported the current sanders are in need of replacement. He reviewed the quotes received for the purchase of a stainless steel sander and recommended the purchase of a Williamson Sander from Tesco at a total cost of $17,110.
Motion by Rocky Baker to approve the purchase of a sander from Tesco at a purchase price of $17,110. Second by Cleo Gallegos. Vote: Leann Smith – Aye; Cleo Gallegos – Aye; Rocky Baker – Aye; Joanne Justesen – Aye.
Discuss/Approve/Authorize Signatures on Access Idaho Service Level Agreement – Payport
Motion by Rocky Baker to authorize the required signatures on the Access Idaho Service Level Agreement documents. Second by Joanne Justesen. Vote: Cleo Gallegos – Aye; Leann Smith – Aye; Rocky Baker – Aye; Joanne Justesen – Aye.
The council meeting ended at 7:55 PM.
