City of Heyburn Council Meeting Minutes
March 26, 2014
7:00 P.M.

 

Council Present:

Rocky Baker, Dusty Galliher and Cleo Gallegos. Dick Galbraith – excused.

 

Employees Present:

Greg Richins, Steven Tuft, Dan Bristol, and Deborah Hopkins.  

 

Visitors Present:

Rose Schmitt, Paul Aston, Mike Painter, Rob Ramsey, Vernon Stephens and Tony Morley.

Meeting conducted by Mayor George A. Anderson who welcomed everyone to the meeting and then led those present in the Pledge of Allegiance.  

 

Discuss/Approve Minutes of the March 12, 2014 Council Meeting

Motion by Rocky Baker to approve the minutes of the March 12, 2014 council meeting as presented. Second by Dusty Galliher. Vote: Rocky Baker – Aye; Cleo Gallegos – Aye; Dusty Galliher - Aye.

 

Discuss/Approve Paying the Bills

Motion by Cleo Gallegos to approve paying the bills as presented with the stipulation that the Costco membership billing be explained. Second by Dusty Galliher. Vote: Rocky Baker – Aye; Cleo Gallegos – Aye; Dusty Galliher - Aye.

 

Discuss/Approve Waiver of Fees for Use of Riverside Park

   Zion’s Lutheran Church - July 20, 2014 – Norma Olson

Mayor Anderson informed those present that Norma Olson was unable to attend the council meeting due to a prior commitment. Those present reviewed the request of the Zion’s Lutheran Church to use the Riverside Park for church services on July 20, 2014. This item was tabled until the April 9, 2014 council meeting to allow time for more information to be presented.

 

Discuss/Approve Declaring April 23, 2014 as Arbor Day for the City of Heyburn

Mayor Anderson asked that the council declare April 23, 2014 as Arbor Day for the City of Heyburn as per the request of Earl Andrew, City Arborist.

 

Motion by Rocky Baker to declare April 23, 2014 as Arbor Day for the City of Heyburn. Second by Cleo Gallegos. Vote: Rocky Baker – Aye; Cleo Gallegos – Aye; Dusty Galliher - Aye.

 

Discuss/Approve Ordinance No. 569 – Clarifying the Use of the Building Permit as a Zoning Permit

This item was discussed by City Attorney Steven Tuft, along with Minidoka County Building Inspector Tony Morley, and Heyburn Planning & Zoning Administrator Paul Aston. After discussion, this item was tabled until the April 9, 2014 council meeting.

Discuss/Approve Ordinance No. 570 – Provide for Temporary Alternate Dates, Locations and Times of City Council Meetings – Adopt in One Reading

City Attorney Steven Tuft explained that Ordinance No. 570 was the result of several court cases throughout the state that had been overturned because the City Council Meeting was relocated to another place to accommodate larger attendance.

 

Motion by Cleo Gallegos to have City Attorney Steven Tuft read Ordinance No. 570 by title only and to adopt in one reading. Second by Dusty Galliher. Vote: Rocky Baker – Aye; Cleo Gallegos – Aye; Dusty Galliher - Aye.

Discuss Ordinance No. 571 – Amendment to Backflow Ordinance

City Attorney Steven Tuft along with City Superintendent Greg Richins explained the necessity of the amendment to the original backflow ordinance. Several options for enforcement of this ordinance were discussed.

 

A revised ordinance will be on the April 9, 2014 city council agenda.

 

Discuss/Approve Bureau of Reclamation Contract 13-07-14-LA813 – Consent to Use Waterline

Mayor Anderson stated this item is not ready for action to be taken on.

 

Discuss Zoning or Subdivision Fees

The zoning and subdivision fees were discussed by those present with additional information provided by Paul Aston and Tony Morley. Paul Aston will solicit more information regarding zoning and subdivision fees from other cities throughout the state. This item was rescheduled for the April 23, 2014 council meeting.

 

Discuss/Approve/Authorize the Use of SPF Water Engineering for Consulting Services

City Attorney Steven Tuft requested the city council ratify the use SPF Water Engineering to assist in formulating a mitigation plan in the Rangen water call for the litigation group represented by Attorney Rob Williams.  Those engineering costs would be shared as part of the group’s litigation costs on a pro-rata basis.  Any work done by SPF to individually assist Heyburn collecting and collating data would be paid separately by Heyburn.

 

Motion by Dusty Galliher to ratify the hiring of SPF Water Engineering for Consulting Services. Second by Rocky Baker. Vote: Rocky Baker – Aye; Cleo Gallegos – Nay; Dusty Galliher - Aye.

Review of Monthly Department Head Reports

The Monthly Department Head Reports were reviewed and discussed by those present.

 

 

Executive Session for Litigation as per Idaho Code 67-2345(f) Litigation

Motion by Rocky Baker to go into Executive Session for Litigation as per Idaho Code 67-2345(f). Second by Cleo Gallegos. Roll Vote: Rocky Baker – Aye; Cleo Gallegos – Aye; Dusty Galliher - Aye.

The Executive Session was conducted by Mayor George A. Anderson. The topic was a matter of litigation which was discussed with those present. No decisions were made. The Executive Session began at 8:18 PM and concluded at 8:55 PM. The City Council meeting did not return to open session and adjourned at 8:55 PM.
