City of Heyburn Council Meeting Minutes
January 22, 2014
7:00 P.M.
Council Present:
Rocky Baker, Dick Galbraith, and Cleo Gallegos. Dusty Galliher – excused.
Employees Present:
Greg Richins, Steven Tuft, Dan Bristol, and Ashlee Langley. Deborah Hopkins - excused.
Visitors Present:
Rose Schmitt, Kevin George, Jody Galbraith, Damien Rodriguez, David De Alba, Mike Devers, Debbie Fetzer, Dee Ann Garner, Don Garner, Leslie Kyles, Ray Kyles, Jeremiah Justesen, Joanne Justesen, John Gillett.
Meeting conducted by Mayor George A. Anderson who welcomed everyone to the meeting and then led those present in the Pledge of Allegiance.
Mayor Anderson Amended the Agenda to include new hire of Reserve Officer James Kilton.
Police Chief Dan Bristol briefly discussed the new hire of Reserve Officer James Kilton. Those present agreed James Kilton would be an asset to the City.
Discuss/Approve Minutes of the January 8, 2014 Council Meeting
Motion by Rocky Baker to approve the minutes of the January 8, 2014 council meeting as presented. Second by Dick Galbraith. Vote: Rocky Baker – Aye; Cleo Gallegos – Aye; Dick Galbraith – Aye.
Discuss/Approve Paying the Bills
Motion by Rocky Baker to approve paying the bills as presented. Second by Cleo Gallegos. Vote: Rocky Baker – Aye; Cleo Gallegos – Aye; Dick Galbraith – Aye.
Consider Modification/Possible Termination of Lease of Old Heyburn Elementary School – John Gillette
John Gillette briefly discussed the closing of his business. Those present requested written notice from Mr. Gillette for vacancy of the Old Heyburn Elementary School. Those present authorized City Attorney Steven Tuft to prepare a Termination of Lease for the Old Heyburn Elementary School with John Gillette.
Discuss/Authorize Fugitive 5K Race – Kevin George
Kevin George discussed plans for an upcoming Fugitive 5K Race to be held in Heyburn on May 3, 2014. He stated the event organizers will have enough volunteers during the race to help with potential safety issues.
Mr. George stated there had not been any reported issues with the Fugitive 5K that was held in Heyburn last year that he was aware of. The upcoming event will be very similar.

Motion by Rocky Baker to authorize Fugitive 5K Race to be held in Heyburn on May 3, 2014, but to require liability insurance as per Heyburn Code Section 5-7-5 (A) (5) (d). Second by Cleo Gallegos. Vote: Rocky Baker – Aye; Cleo Gallegos – Aye; Dick Galbraith – Aye.
Discuss/Approve Hiring Brooks & Associates to Conduct Electric Cost of Service Study
City Electric Consultant Ralph Williams participated in the meeting via the telephone. He reported he had reviewed the information from Brooks & Associates and felt confident that he would be able to present the findings to the City Council together with Brooks & Associates via the telephone and thus be able to help control some of the potential expenses that may be incurred. The cost for the presentation of the COSA was estimated to be $2,400.
Motion by Dick Galbraith to approve hiring Brooks & Associates to do the Electric Cost of Service Study with the Financial Forecast option at an estimated cost of $12,600. Second by Rocky Baker. Vote: Rocky Baker – Aye; Cleo Gallegos – Aye; Dick Galbraith – Aye.
Discuss/Approve Bonneville Power Contract No. 11ES-11235 Amendment No. 1 – Ralph Williams
City Electric Consultant Ralph Williams stated this contract amendment is simply extending the City of Heyburn’s Energy Conservation Agreement by one year. He recommended the City accept this offer.
Motion by Cleo Gallegos to authorize Mayor Anderson to sign the Bonneville Power Contract No. 11ES-11235 Amendment No. 1 as presented. Second by Rocky Baker. Roll Call Vote: Rocky Baker – Aye; Cleo Gallegos – Aye; Dick Galbraith – Aye.
Discuss/Approve Waiver of Fees for the Use of the Amphitheater – Don Garner
Don Garner, National President and Founder of Brothers in Christ presented information about their organization, history, and their upcoming event tentatively planned for Saturday, July 19, 2014 at the Heyburn Amphitheater. He asked for the fees to be waived.
Motion by Cleo Gallegos to waive the fees for the use of the Amphitheater on July 19, 2014, but to require a refundable deposit as per Amended Resolution 2009-6 as well as liability insurance per Heyburn Code Section 5-7-5 (A) (5) (d). Second by Rocky Baker. Vote: Rocky Baker – Aye; Cleo Gallegos – Aye; Dick Galbraith – Aye.
Discuss/Approve 2014 Salvage Yard License for Gibson Truck & Auto
Mayor Anderson stated the Salvage Yard License fees for 2014 have been paid by Gibson Truck & Auto and recommended approval of their license.
Motion by Cleo Gallegos to approve the 2014 Salvage Yard License for Gibson Truck & Auto. Second by Dick Galbraith. Vote: Rocky Baker – Aye; Cleo Gallegos – Aye; Dick Galbraith – Aye.

Heyburn Riverside RV Park Camp Host Recommendation – Earl Andrew
Heyburn Riverside RV Park Manager Earl Andrew stated that he recommends the hiring of Bob & Lisa Cordaro to be the Heyburn Riverside RV Park Manager for the 2014 summer season. Mayor Anderson asked the council to ratify the hiring.
Motion by Rocky Baker to ratify Mayor Anderson’s appointment of Bob & Lisa Cordaro as Heyburn Riverside RV Park Camp Hosts for the Summer 2014 season. Second by Dick Galbraith. Vote: Rocky Baker – Aye; Cleo Gallegos – Aye; Dick Galbraith – Aye.
Riverside Park Equipment/Building Grant – Earl Andrew
Earl Andrew informed those present regarding a grant opportunity to be able to purchase park equipment and also a building located at the Riverside Park. He asked council members for authorization to submit the grant. Total cost for equipment and the building would be $35,810.00 of which, the City would be responsible for $14,518.00.
Motion by Rocky Baker to authorize the submittal of the Park Equipment/Building Grant in the amount of $14,518.00. Second by Dick Galbraith. Vote: Rocky Baker – Aye; Cleo Gallegos – Aye; Dick Galbraith – Aye.
Idaho Community Action - Predatory Payday Loan Informational Presentation –
Damien Rodriguez
Damien Rodriguez representing Idaho Community Action Group spoke regarding their concerns on regarding the problem arising because the State of Idaho does not have interest limits. He urged the Heyburn City Council to consider limiting payday loan businesses within the City limits. He also informed those present, their group is working with two Idaho State senators on limiting payday loan interest on a state level.
Review of Monthly Department Head Reports
The Monthly Department Head Reports were reviewed by those present.
The council meeting adjourned at 8:20 PM.
