City of Heyburn Council Meeting Minutes
February 12, 2014
7:00 P.M.
Council Present:
Rocky Baker, Dick Galbraith, Dusty Galliher and Cleo Gallegos.
Employees Present:
Greg Richins, Steven Tuft, Dan Bristol, and Deborah Hopkins.
Visitors Present:
Rose Schmitt, Jeremiah Justesen, Kelly Anthon, Ken Mort, Debbie Heinze, Jeana Allred, Vernon Stephens, Mike Painter, and Joanne Justesen.
Meeting conducted by Mayor George A. Anderson who welcomed everyone to the meeting and then led those present in the Pledge of Allegiance. Mayor Anderson announced that agenda item No. 4 – Consideration of Minidoka Joint Powers Animal Control – Kelly Anthon – would be moved to Item No. 11.
Discuss/Approve Minutes of the January 22, 2014 Council Meeting
Motion by Rocky Baker to approve the minutes of the January 22, 2014 council meeting as presented. Second by Dusty Galliher. Vote: Rocky Baker – Aye; Cleo Gallegos – Aye; Dick Galbraith – Aye; Dusty Galliher - Aye.
Discuss/Approve Paying the Bills
Motion by Rocky Baker to approve paying the bills as presented. Second by Dick Galbraith. Vote: Rocky Baker – Aye; Cleo Gallegos – Aye; Dick Galbraith – Aye; Dusty Galliher - Aye.
Discuss/Determine a Process for Renaming Ga’ Lawn Park
Mayor Anderson opened the floor for discussion of renaming Ga’ Lawn Park. He suggested the name of “Central Park”. Councilmember Galliher suggested “Riverton Park.” After discussion, it was decided to solicit possible names from the Heyburn residents by putting a suggestion box at City Hall and to also put a request on the City of Heyburn webpage. This item will be brought back for discussion at the February 26, 2014 council meeting.
Discuss Possibility of Trademarking the City Logo
After discussion, there was no action taken on this item.
Discuss/Approve the Hiring of Williams, Meservy & Lotchspeich – Water Rights Attorney
City Attorney Steven Tuft suggested to the Mayor and council members to hire Rob Williams of Williams, Meservy & Lotchspeich to represent the City of Heyburn in the upcoming water issues as a result of the Rangen water call.

Motion by Dusty Galliher to hire Williams, Meservy & Lotchspeich to represent the City for the upcoming Rangen water call mitigation. Second by Rocky Baker. Vote: Rocky Baker – Aye; Cleo Gallegos – Aye; Dick Galbraith – Aye; Dusty Galliher - Aye.
Introduce James E. Kilton as Reserve Officer for the Heyburn Police Department – Chief Dan Bristol
City of Heyburn Police Chief introduced James E. Kilton to those present.
Mayor Anderson and council members welcomed him to the City and thanked him for his willingness to serve.
Review Draft of Heyburn Police Department Rules of Performance – Chief Dan Bristol
Heyburn Police Chief Dan Bristol provided a brief history on the Heyburn Police Department Rules of Performance. After discussion, Chief Bristol was asked to provide an updated copy for review at the next city council meeting.
Discuss/Declare Surplus Items – Greg Richins
City Superintendent Greg Richins presented a list of items that he would like to be declared as “surplus.” After answering questions, Superintendent Richins was directed to arrange the auction of the items as presented.
Discuss/Approve Ordinance No. 567 – Initiative, Referendum & Recall Code – Steven Tuft
City Attorney Steven Tuft explained the reason for Ordinance No. 567 was because of changes made in the legislature that required a change to the Heyburn City Code.
Motion by Rocky Baker to have City Attorney Steven Tuft read Ordinance No. 567 by title only, adopt in one reading. Second by Dick Galbraith. Vote: Rocky Baker – Aye; Cleo Gallegos – Aye; Dick Galbraith – Aye; Dusty Galliher - Aye.

Discuss/Approve Consider Employees’ Request to Exchange the Veteran’s Day Holiday for
December 26, 2014
Mayor Anderson stated that he had received a request on behalf of the employees to consider an exchange of working the Veteran’s Day holiday in exchange for having December 26, 2014 off.

Motion by Cleo Gallegos to allow the employees to work the 2014 Veteran’s Day holiday in exchange for having December 26, 2014 off. Second by Rocky Baker. Vote: Rocky Baker – Aye; Cleo Gallegos – Aye; Dick Galbraith – Aye; Dusty Galliher - Aye.
Consideration of Minidoka Joint Powers Animal Control – Kelly Anthon
Rupert City Administrator Kelly Anthon presented a proposal to ask the City of Heyburn to reconsider being a part of the Minidoka Joint Powers Animal Control.
Executive Session for Personnel as per Idaho Code 67-2345(a) & (f) Personnel & Litigation
Motion by Rocky Baker to go into Executive Session for Personnel and Litigation as per Idaho Code 67-2345(a) and (f). Second by Dick Galbraith. Roll Vote: Rocky Baker – Aye; Cleo Gallegos – Aye; Dick Galbraith – Aye; Dusty Galliher - Aye.

The Executive Session was conducted by Mayor George A. Anderson. The topics were a matter of personnel and a matter of litigation. No decisions were made. The Executive Session began at 8:17 pm and concluded at 9:08 pm. Kelly Anthon left the meeting at 8:36 pm. The City Council meeting did not return to open session.
The council meeting adjourned at 9:08 PM.
