City of Heyburn Council Meeting Minutes
February 26, 2014
7:00 P.M.
Council Present:
Rocky Baker, Dick Galbraith, Dusty Galliher and Cleo Gallegos.
Employees Present:
Greg Richins, Steven Tuft, Dan Bristol, and Ashlee Langley. Deborah Hopkins – excused.
Visitors Present:
Rose Schmitt, Jeremiah Justesen, Joanne Justesen, Rykah Justesen, and Bud Whiting.
Meeting conducted by Mayor George A. Anderson who welcomed everyone to the meeting and then led those present in the Pledge of Allegiance.
Discuss/Approve Minutes of the February 12, 2014 Council Meeting
Motion by Rocky Baker to approve the minutes of the February 12, 2014 council meeting as presented. Second by Dick Galbraith. Vote: Rocky Baker – Aye; Cleo Gallegos – Aye; Dick Galbraith – Aye; Dusty Galliher - Aye.
Discuss/Approve Paying the Bills
Motion by Dusty Galliher to approve paying the bills as presented. Second by Cleo Gallegos. Vote: Rocky Baker – Aye; Cleo Gallegos – Aye; Dick Galbraith – Aye; Dusty Galliher - Aye.
Discuss/Approve Waiver of Fees for the Use of Riverside Park & Amphitheater
a) Vikingman Triathlon – Karen Whiting– August 22-23, 2014
Karen Whiting appeared before the mayor and council to ask for the fees to be waived for the use of the Riverside Park and the Amphitheater for the Vikingman on August 22-23, 2014.
Motion by Cleo Gallegos to waive the fees for the use of the Riverside Park and the Amphitheater on August 22-23, 2014 but to require a $250.00 deposit and insurance, as well as photos of the park before and after event. Second by Dusty Galliher. Vote: Rocky Baker – Aye; Cleo Gallegos – Aye; Dick Galbraith – Aye; Dusty Galliher - Aye.
Minidoka County School District – School Bond Information – Kent Jackson
Minidoka County School District Superintendent Kent Jackson presented information on the upcoming School Bond Election to be held on March 11, 2014.
Discuss/Rename Ga’ Lawn Park
After discussion, it was decided to delay the possible renaming of Ga’ Lawn Park until more input was received from Heyburn residents. This item will be on the March 12, 2014 city council agenda.

Discuss/Re-Affirm David Nebeker and Dan Lloyd to the Heyburn Urban Renewal Agency
Mayor Anderson stated that he had received a request from Ralph Williams, the Heyburn Urban Renewal Agency Chairman stating the terms of David Nebeker and Dan Lloyd had expired. Mayor Anderson stated he has agreed with the appointment of these gentlemen to the committee and asked the city council members to re-affirm his appointment.
Motion by Cleo Gallegos to reaffirm the appointment of David Nebeker and Dan Lloyd to the Heyburn Urban Renewal Agency. Second by Rocky Baker. Vote: Rocky Baker – Aye; Cleo Gallegos – Aye; Dick Galbraith – Aye; Dusty Galliher - Aye.
Discuss/Approve Heyburn Police Department Rules of Performance – Chief Dan Bristol
Heyburn Chief of Police Dan Bristol reviewed the draft of the Heyburn Police Department Rules of Performance with those present.
Motion by Cleo Gallegos to adopt the Heyburn Police Department Rules of Performance as presented. Second by Dusty Galliher. Vote: Rocky Baker – Aye; Cleo Gallegos – Aye; Dick Galbraith – Aye; Dusty Galliher - Aye.
Discuss/Adopt Resolution No. 2014-1 Destruction of Certain Semi-Permanent & Temporary Records
City Attorney Steven Tuft explained this is an annual resolution to destroy records. He also stated the Idaho State Historical Society has been contacted and they have no interest in the records to be destroyed.
Motion by Dusty Galliher to adopt Resolution No. 2014-1 Destruction of Certain Semi-Permanent and Temporary Records. Second by Rocky Baker. Roll Call Vote: Rocky Baker – Aye; Cleo Gallegos – Aye; Dick Galbraith – Aye; Dusty Galliher - Aye.
Review of Monthly Department Head Reports
The Monthly Department Head Reports were reviewed and discussed by those present.
Executive Session for Personnel as per Idaho Code 67-2345 (e) & (f) Litigation and Matters of Trade or Commerce
Motion by Rocky Baker to go into Executive Session for Litigation as per Idaho Code 67-2345 (e) and (f) for litigation and matters of trade or commerce. Second by Cleo Gallegos. Roll Vote: Rocky Baker – Aye; Cleo Gallegos – Aye; Dick Galbraith – Aye; Dusty Galliher - Aye.

The Executive Session was conducted by Mayor George A. Anderson. The topic was a matter of litigation and a matter of trade or commerce which were discussed with those present. No decisions were made. The Executive Session began at 8:10 pm and concluded at 8:50 pm. The City Council meeting did not return to open session.
The council meeting adjourned at 8:50 pm.
