City of Heyburn Council Meeting Minutes
March 11, 2009
7:00 P.M.
Council Present:
Cleo Gallegos, Rocky Baker, Leann Smith and Dee Ray Bailey.
Employees Present:
Linda Dayley, Scott Spevak and Steve Tuft.
Visitors Present: Dan Bristol, Garth Shaw, Stan Zielinski, Dennie Gleed, Larry Nisle and Margi Owens.
Meeting conducted by Mayor Anderson.
Pledge of Allegiance led by Mayor Anderson.
Amend Agenda to include Resolution No. 2009-2 referring to item No. 3 and to exclude item No. 4 the Red Flag Rule which we will address next month.
Approve Minutes of the Council Meeting on February 25, 2009.
Motion by Rocky Baker to approve the minutes for the Council Meeting on February 25, 2009 as written. Second by Leann Smith. Vote: Cleo Gallegos - Aye; Rocky Baker - Aye; Leann Smith - Aye; Dee Ray Bailey - Abstained because he was absent from that meeting.
Approve Paying the Bills.
Motion by Dee Ray Bailey to approve paying the bills. Second by Rocky Baker. Vote: Cleo Gallegos - Aye; Rocky Baker - Aye; Leann Smith - Aye; Dee Ray Bailey - Aye.
Discuss/Approve an Agreement Between the City of Heyburn and the School District for an Irrigation Line.
Attorney Steve Tuft summarized Resolution 2009-2 which the Joint School District No. 331 requested concerning the consent to use the City of Heyburn’s easement.

RESOLUTION OF THE CITY OF HEYBURN CONSENTING TO USE OF FOURTH STREET IN THE CITY OF HEYBURN BY THE JOINT SCHOOL DISTRICT NO. 331 TO BURY AN UNDERGROUND IRRIGATION WATER LINE AND GRANT OF EASEMENT.
Motion by Dee Ray Bailey to approve Resolution No. 2009-2. Second by Cleo Gallegos. Vote: Cleo Gallegos - Aye; Rocky Baker - Aye; Leann Smith - Aye; Dee Ray Bailey - Aye.
Discuss Resolution 2009-3 the Red Flag Rule for Identity Theft.
This item will be on an agenda in April.
Discuss/Approve the Mayor’s Signature on the Memorandum of Understanding Between the College of Southern Idaho and the Heyburn Police Department.
Police Chief Dan Bristol explained to the Mayor and Council that the College of Southern Idaho maintains a law enforcement cadet practicum program designed to provide students with real-life, work-based learning opportunities to supplement their classroom education.
After discussion Leann Smith made a motion to approve the Mayor’s and the Chief of Police signatures on the Memorandum of Understanding between the College of Southern Idaho and the Heyburn Police Department. Second by Dee Ray Bailey. Vote: Cleo Gallegos - Aye; Rocky Baker - Aye; Leann Smith - Aye; Dee Ray Bailey - Aye.
Discuss/Approve the Budget Hearing Date and Location.
City Clerk Linda Dayley explained that pursuant to I.C. 63-803(A) all taxing districts are now required to notify the County Clerk no later than April 30, 2009, of the date and location of the districts Budget Hearing. This information will be included on the Tax Assessment Notice sent out by the Assessor in May. Unless there is an objection the date of the Budget Hearing will be set for August 12, 2009 at 7:00 p.m. in the Council Chambers at Heyburn City Hall. Council was in agreement.
Mayor Time:
Attorney Steve Tuft handed out to the Mayor and Council an Agreement and Grant of Encroachment Easement for them to read and it will be on the next agenda.
Mayor Anderson discussed the demolition going on at the Burley Industrial Park and asked Police Chief Dan Bristol if they could do some additional patrol in that area.
Dennie Gleed and Larry Nisle invited the public to a Speak up for Morality Conference and a legal issues no host luncheon. The conference starts off with the Legal Issues Luncheon at the Burley Inn March 27th at 11:30, advanced tickets required. The free conference will convene at the Minico High School auditorium March 27th and March 28 at 7:00 p.m.
Councilperson Cleo Gallegos applauded the Mayor for receiving an award for being one of the Mini-Cassia’s Best Mayors.
