City of Heyburn Council Meeting Minutes
March 25, 2009

Council Present:

Approve Minutes of the Council Meeting on March 11, 2009.
Motion by Leann Smith to approve the minutes for the Council Meeting on March 11, 2009 as written. Second by Cleo Gallegos. Vote: Cleo Gallegos - Aye; Rocky Baker - Aye; Leann Smith - Aye.
Approve Paying the Bills.
Motion by Rocky Baker to approve paying the bills. Second by Leann Smith. Vote: Cleo Gallegos - Aye; Rocky Baker - Aye; Leann Smith - Aye.
Discuss/Approve Agreement and Grant of Encroachment Easement Between the City of Heyburn and the Joint School District.
Mayor Anderson explained that this easement grants a strip of land not to exceed twenty (20) feet in width, for the benefit of grantee only, which may install trees, bushes and other landscaping on the encroachment. The servient estate of Grantor affected by the grant of this easement is located in the County of Minidoka, State of Idaho.
The City will maintain any pump, pipeline or sprinkler equipment at its sole cost and will hold the Joint School District harmless from any claims that may arise as a result of the construction, operation and maintenance of a pump, pipeline or sprinkler equipment on the school property. The City of Heyburn shall maintain the encroachment at their own cost, which includes maintaining the weeds and mowing the grass.
Motion by Cleo Gallegos to approve the Agreement and Grant of Encroachment Easement Between the City of Heyburn and the Joint School District for the continuation of the existing City’s walking path. Second by Rocky Baker. Vote: Cleo Gallegos - Aye; Rocky Baker - Aye; Leann Smith - Aye.
Discuss/Approve Proclaiming April as the Fair Housing Month.
Mayor Anderson informed the Council that this Proclamation is a part of the requirements for receiving federal funding for the City’s wastewater project.
Motion by Leann Smith proclaiming April as Fair Housing Month. Second by Cleo Gallegos. Vote: Cleo Gallegos - Aye; Rocky Baker - Aye; Leann Smith - Aye.
Discussion of Future Power Needs - Ralph Williams.
Ralph Williams from United Electric Coop updated the Mayor and Council about BPA Tier 2 with the load forecast.
Discuss/Approve Police Grant - Dan Bristol.
Dan Bristol presented a CHRP Grant to the Mayor and Council explaining that the grant would provide 100 percent funding for approved entry-level salaries and benefits for 3 years (36 months) for newly-hired, full-time sworn officer positions (including filling existing unfounded vacancies) or for rehired officers who have been laid off, or are scheduled to be laid off on a future date, as a result of local budget cuts. In addition, there is no cap on the number of positions an agency may request, but awards will be limited to available funding.
Grantees must retain all sworn officer positions awarded under the CHRP grant for a period of one year (12 months) following the conclusion of grant funding. The retained and/or local funds, over and above the number of locally funded positions that would have existed in the absence of a grant.

Mayor Anderson announced that there would be a planned power outage for Bonneville Power System upgrades on Sunday March 29 from 4 o’clock p.m. until 8 o’clock p.m.
