May 13, 2009

Council Present:

Cleo Gallegos, Rocky Baker, Leann Smith and Dee Ray Bailey.

Employees Present:

Linda Dayley, Scott Spevak, Dan Bristol and Steve Tuft.

Approve Minutes of the Council Meeting on April 22, 2009.

Motion by Rocky Baker to approve the minutes for the Council Meeting on April 22, 2009. Second by Leann Smith. Vote: Cleo Gallegos - Aye; Rocky Baker - Aye; Leann Smith - Aye; Dee Ray Bailey - Abstained.

 

Approve Paying the Bills except the Bailey Oil Bill.

Motion by Cleo Gallegos to approve paying the bills except the Bailey Oil bill. Second by Dee Ray Bailey. Vote: Cleo Gallegos - Aye; Rocky Baker - Aye; Leann Smith - Aye; Dee Ray Bailey - Aye.

Discuss/Approve Ordinance No. 517 for Zoning and Subdivision Ordinances for the 2009 Proposed Amendments.

AN ORDINANCE OF THE CITY O HEYBURN, MINIDOKA COUNTY, IDAHO; AMENDING PROTIONS OF TITLES 8 AND 9 AS FOLLOWS; 9-2-2 E. AMENDING THE DEFINITIONS OF CLASS A, B AND C MANUFACTURED HOUSING; 8-5-2 AMENDING TO DITINGUISH BETWEEN PRIVATE AND COMMERCIAL USES; REVISING THE PERMIT USES FOR CLASS C MANUFACTURED HOUSING AND AMENDING NOTE 8; PROVIDING FOR PERMITTED USES FOR HIGH VOLTAGE TRANSMISSION LINES; PRIVATE HUNTING CLUBS OR RESERVES; PROVIDED FOR SMALL 10 LOT SUBDIVISION IN THE “AH” AND “AM” DISTRICTS AND DEFINITIONS OF SAME AS A NOTE 15; AMENDING THE PLACES OF USE FOR CAFO - COMMERCIAL OPERATIONS; DELETING THE USE OF “CREMATORIUM” AND COMBINING IT WITH “FUNERAL PARLOR”; AMEND THE USES FOR RIDING ARENAS - PRIVATE AND PROVIDE FOR EXEMPTION FOR FAMILY USE IN A NEW NOTE 16; AMENDING 8-5-3 TO PROVIDE FOR NEW SETBACK REQUIREMENTS FOR STRUCTURAL PROJECTIONS; AMENDING 8-13-6 TO PROVIDE A NEW SECTION AS TO REQUIREMENTS FOR BUILDING PERMITS; AMENDING 8-14-12 TO CLARIFY THE APPEALS PROCESS; AMENDING 8-14-13 TO PROVIDE FOR A NEW SECTION DEALING WITH APPEALS AND NOTICES OF APPEAL; AMENDING EXISTING 8-14-13 TO BE RENUMBERED AS 8-14-14 AMENDING SAME TO CLARIFY TO TOLLING PERIOD DURING MEDIATION; AMENDING 8-15-2 F REGARDING REQUIREMENTS FOR SPECIAL USES PERMITS; AMENDING 8-17-1C3 TO CLARIFY THE CAFO BUILDING PERMIT PROCESS; AMENDING 8-17-4 B TO PROVIDE FOR A WAIVER FOR EXPANSION OF NON-CONFORMING USE; AMENDING 8-17-5 D TO CLARIFY CAFO SET BACK REQUIREMENTS; DELETING 8-17-10 C; AND AMENDING 9-3-3 K 1 TO PROVIDE POSSIBLE EXTENSION OF THE ONE YEAR LIMIT ON PLAT APPROVALS; AND TO SUSPEND THE THREE READINGS OF THIS ORDINANCE AND PROVIDED FOR PASSAGE AFTER ONE READING AND PROVIDING FOR EFFECTIVE DATE.

 

Motion by Dee Ray Bailey to read Ordinance No. 517 by title only suspending the rule of three readings. Second by Leann Smith. Vote: Cleo Gallegos - Aye; Rocky Baker - Aye; Leann Smith - Aye; Dee Ray Bailey - Aye.

 

Attorney Steve Tuft read Ordinance No. 571 by title only.

 

Motion by Rocky Baker to adopt Ordinance No. 517. Second by Leann Smith. Roll Call Vote: Cleo Gallegos - Aye; Rocky Baker - Aye; Leann Smith - Aye; Dee Ray Bailey - Aye.

 

Discuss the Concept Report on 21st Street - Keller and Associates.

Matt Price and Todd Tuckett, representing Keller and Associates, reviewed with the Mayor and Council the 21st Street Concept Report.

 

Motion by Cleo Gallegos to approve the Mayor’s signature on the 21st Street Concept Report. Second by Dee Ray Bailey. Vote: Cleo Gallegos - Aye; Rocky Baker - Aye; Leann Smith - Aye; Dee Ray Bailey - Aye.

 

Discuss/Approve Membership in the Northwest Intergovernmental Energy Supply and or Bonneville Power for Tier II Power in the future.

Tier II power refers to the amount not covered by the base supplied from BPA. Because BPA is part of the U.S. Department of Energy, the federal government could raise prices to market level. The federal government can also mandate green power sources, which are significantly more expensive. Membership in the Northwest Requirements Utilities (NRU), a nonprofit association representing utilities in seven states, allows a municipality to purchase additional power from a supplier that doesn’t operate under federal mandates.

 

City Superintendent updated the Mayor and Council on the Northwest Requirements Utilities meeting that he attended.

Mayor and Council discussed a letter from Michael Tribe concerning the old Heyburn Elementary School.
