Approve Minutes of the Council Meeting on June 24, 2009.

Approve Paying the Bills Except the Bailey Oil Bill.

Discuss/Approve a New Agreement to Provide Prosecuting Services - Lance Stevenson.
Lance Stevenson, Prosecuting Attorney introduced Chris Draper Assistant to the Prosecutor, then presented to the Mayor and Council a proposed ratification of the current Agreement for Prosecuting Services. Lance explained that in an effort to obtain more viable cost-effective prosecution for the County, the Minidoka County Commissioners requested an examination of the current agreement, dated October 27, 2004. Under this agreement, the City of Heyburn pays $375 monthly to the County for prosecution of infraction and misdemeanor actions and violations of state laws, county ordinances, and city ordinances committed within the City of Heyburn. The City of Heyburn receives from Minidoka County funds accumulated from case convictions within the Court.
As the information provided reflects, the average salary cost to our office to prosecute a citation or a misdemeanor is $23.82. This cost does not include supplies and other expenses. Based on the current agreement, the current average price paid by the City of Heyburn is $7.75 per citation. There is considerable discrepancy between the two figures. That stated, we are proposing to ratify the agreements to $600 per month starting October 1, 2010 the beginning of the new fiscal year for the City of Heyburn which will alleviate some of the burden the County bears in prosecuting cases at a loss, while being placed at a reasonable price to the City of Heyburn.
After discussion Leann Smith made a motion to approve the Agreement to Provide Prosecution Services from Minidoka County. Second by Dee Ray Bailey. Vote: Cleo Gallegos - Aye; Rocky Baker - Nay; Leann Smith - Aye; Dee Ray Bailey - Aye.

Discuss/Approve Ordinance No. 519 on changing 17th Street between the two old Heyburn Schools.
AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF HEYBURN, IDAHO, REPEALING HEYBURN CODE SECTION 6-3-9; AND PROVIDING FOR SUSPENSION OF RULES AS TO THREE READINGS AND PROVIDING FOR EFFECTIVE DATE.
Motion by Dee Ray Bailey to read Ordinance No. 519 waiving the rule requiring three separate readings and read by title only. Second by Rocky Baker. Vote: Cleo Gallegos - Aye; Rocky Baker - Aye; Leann Smith - Aye; Dee Ray Bailey - Aye.

After discussion Rocky Baker made a motion to approve Ordinance No. 519. Second by Dee Ray Bailey. Vote: Cleo Gallegos - Aye; Rocky Baker - Aye; Leann Smith - Aye; Dee Ray Bailey - Aye.
Discuss/Approve Proposed Minidoka County Dispatch Services.
Sheriff Kevin Halverson presented to the Mayor and Council a proposal for Minidoka County Dispatch Services, which was provided in their council packets. After discussion this item was tabled until the next council meeting.
Discuss/Approve Surplus Equipment - City Superintendent Scott Spevak.
City Superintendent informed the Mayor and Council that there were two vehicles, which neither one of them were run able, that he would like permission to declare them as surplus. One is a 1988 Chevrolet Blazer that was from a drug seizure and the other one is a 2001 Crown Victoria from the Police Department.
Motion by Dee Ray Bailey to declare the 1988 Chevrolet Blazer and the 2001 Crown Victoria as surplus. Second by Leann Smith. Vote: Cleo Gallegos - Aye; Rocky Baker - Aye; Leann Smith - Aye; Dee Ray Bailey - Aye.
Discuss Changing the Ordinance for Animal Control Enforcement -Councilman Dee Ray Bailey.
Councilman Dee Ray Bailey explained that he felt the existing ordinance that the City already has is a good ordinance but that it needs to be enforced. Dee Ray also expressed that Mike Devers should be trained and certified for darting the dogs. After discussion between the Council and Dan Bristol it was the decision of the Council to have Attorney Steve Tuft prepare a draft ordinance to change the wording of the existing Ordinance to make the fines for $50, $100 and $300 plus court costs and have it ready for the next council meeting.
