Property and Evidence
The Heyburn Police Department has officers who maintains and secures all evidence, found property, safekeeping property for court presentation or until the property can be returned to the rightful owner or legally destroyed.
TO HAVE PROPERTY RETURNED, SCHEDULE AN APPOINTMENT.
To pick up evidence, please contact the Heyburn Police Department in advance at 208-679-4545 to be put in contact with an Evidence Technician and schedule an appointment to retrieve your property. Without an appointment, you may not be able to pick up your property.
Evidence in criminal cases will not be released without either a court order, or written approval from the prosecutor's office. Typically this is 45 days after a case is resolved in court, or after expiration of the statutes of limitations. Any criminal contraband items such as illegal firearms (i.e. sawed off shotguns) or controlled substances shall be destroyed and not returned.
PROPERTY WILL NOT RELEASE WITHOUT PROPER AUTHORIZATION.
You must bring with your valid government-issued photo identification and your report number as well as any paperwork that was sent to you (I.E. notification letter, disposition sheet, etc.).
If you do not know the report number associated with your property, you may contact the Heyburn Police Department at 208-679-4545. Our Evidence Technicians will assist you in locating that information and setting up an appointment to pick up your property.
HAVING ANOTHER PERSON RETRIEVE YOUR PROPERTY
If you are having someone else pick up your property, you must complete the Owner Authorization to Release Property Form, have it notarized and have your designee present it when retrieving your property. Your designee must have an appointment.
FIREARMS RELEASE PROCEDURE
To retrieve a firearm which is in the custody of the Heyburn Police Department, you must fill out and return the Firearm Release Request Form.
Once this form has been processed and your eligibility to possess firearms is confirmed, an Evidence Technician will contact you to make an appointment for the release. Firearms will be released by appointment only.
If you have a Concealed Permit, fill out the Firearm Release Request Form and provide a copy of your Concealed Permit when submitting the form. We will research the status of the case and if the case is resolved, an Evidence Technician can process your request.
If you don't have a Concealed Permit, fill out the Firearm Release Request Form and turn it in. An Evidence Technician will run a background check and we will research the status of the case. If the case is settled, an Evidence Technician will contact you for the release.
