July 26, 2017

Mayor: Mayor Cleo Gallegos.
Council Present: Joanne Justesen, Chad Anderson, Dick Galbraith, and Dusty Galliher.
Employees Present:
Michael Tribe, Ralph Martini, Eric Christensen, Dan Bristol, and Ashlee Langley.
Visitors Present:
Paul Ross, Connie Stopher, Lyle Santos, Nancy Santos, Jade Santos, Austin Santos, Jo Elg, Karman Klassy, and Rose Schmitt.
Welcome & Pledge
Meeting conducted by Mayor Cleo Gallegos who welcomed everyone to the meeting.
Mayor Gallegos asked Councilwoman Joanne Justesen to lead those present in the Pledge of Allegiance.
Mayor Cleo Gallegos asked for a motion to amend the agenda to remove item number 13 Duration of Stay at Heyburn Riverside RV Park from the agenda. The Mayor stated that she was contacted after the agenda was set and told there was no need for further discussion on this item.
Motion by Dusty Galliher to amend the agenda to remove item number 13 from the agenda. Second by Joanne Justesen. Roll-Call Vote: Chad Anderson – Aye; Dick Galbraith – Aye; Dusty Galliher – Aye; Joanne Justesen – Aye.
Discuss/Approve Minutes of the July 12, 2017 Council Meeting
Motion by Dusty Galliher to approve the minutes of the July 12, 2017 Council Meeting as presented. Second by Dick Galbraith. Roll-Call Vote: Chad Anderson – Aye; Dick Galbraith – Aye; Dusty Galliher – Aye; Joanne Justesen – Abstain.
Discuss/Approve Paying the Bills

Introduction/Update on Southern Idaho Economic Development – Connie Stopher
Connie Stopher introduced herself as the Executive Director for Southern Idaho Economic Development and provided those present with a brief update on the changes that are taking place within their organization.
Those present thanked Connie Stopher for the update.
Update from Total Waste Management on Route Changes – Lyle Santos
Total Waste Management Owner Lyle Santos talked to the City Council about a change in routes taking effect August 15, 2017. This change would change the Monday route to a Tuesday route and would only effect about 20 residents.

Discuss/Approve Bonneville Power Administration Energy Conservation Agreement (ECA)
Contract No. 17ES-11492
Jo Elg, General Manager for United Electric presented the Bonneville Power Administration Energy Conservation Agreement to those present. Jo Elg explained that this agreement is for the Energy Efficiency program that the City of Heyburn offers its residents through the Bonneville Power Administration. Jo Elg stated the City signed an agreement back in 2010 to provide these services to the residents of Heyburn but that agreement is set to expire at the end of this fiscal year. Jo Elg stated there are no major changes to the agreement and the changes that were made by BPA were to better reflect the way the processes truly are and to delete obsolete terms. Jo Elg recommended the council to approve the agreement as presented.
Motion by Joanne Justesen to approve the Bonneville Power Administration Energy Conservation Agreement (ECA) Contract No. 17ES-11492 as presented. Second by Dick Galbraith. Roll-Call Vote: Chad Anderson – Aye; Dick Galbraith – Aye; Dusty Galliher – Aye; Joanne Justesen – Aye.
Discuss/Approve the Extension of Right of Entry Agreement with the LDS Church
City Attorney Michael Tribe stated that the Right of Entry Agreement the City had with the LDS Church to move some power poles has expired and the work has not yet been completed. Mr. Tribe recommended the council approve the extension of the Right of Entry Agreement with the LDS Church to allow the City to get back on the property to finish the pole replacement.
Motion by Dick Galbraith to approve the Extension of Right of Entry Agreement with the LDS Church as presented. Second by Chad Anderson. Roll-Call Vote: Chad Anderson – Aye; Dick Galbraith – Aye; Dusty Galliher – Aye; Joanne Justesen – Aye.
Discuss/Approve Life Locks Surplus Sale to Cassia County Sheriff
Police Chief Dan Bristol asked the council to consider selling the Cities life locks to Cassia County Sheriff’s Office.
Motion by Dick Galbraith to approve the Surplus sale of the cities life locks to Cassia County Sheriff’s office in the amount of $500.00 with an agreement in place for the sale as recommended by City Attorney Michael Tribe. Second by Joanne Justesen. Roll-Call Vote: Chad Anderson – Aye; Dick Galbraith – Aye; Dusty Galliher – Aye; Joanne Justesen – Aye.
Discuss/Approve/Adopt the 2017-18 FY Tentative Budget
Motion by Dick Galbraith to adopt the 2017-18 FY Tentative Budget as presented. Second by Joanne Justesen. Roll-Call Vote: Chad Anderson – Aye; Dick Galbraith – Aye; Dusty Galliher – Nay; Joanne Justesen – Aye.

City Clerk Ashlee Langley stated that copies of the State Licenses and the Minidoka County Licenses have been received from all the applicants listed, as well as payment for the licenses.
Motion by Joanne Justesen to approve the 2017-18 Beer & Wine License for Tag, Inc., Hub Plaza, Love’s Travel Stops & County Stores, Inc. Joe’s River Bar, and Conner’s Café Inc. Second by Dick Galbraith. Roll-Call Vote: Chad Anderson – Aye; Dick Galbraith – Aye; Dusty Galliher – Aye; Joanne Justesen – Aye.
Discuss/Possibly Appoint Paul Ross as the new City Attorney
Mayor Gallegos stated she’s appointed Paul Ross as the new City Attorney for the City of Heyburn. She asked for the council to affirm her decision.
Roll-Call Vote: Chad Anderson – Affirm; Dick Galbraith – Affirm; Dusty Galliher – Affirm; Joanne Justesen – Affirm.
The appointment of Paul Ross was affirmed by all four members of the City Council.
Discuss/Approve City Administrator Job Description
Mayor Gallegos asked the council to consider tabling this item to give newly appointed City Administrator Tony Morley time to review and provide comments.
Motion by Dusty Galliher to approve tabling the City Administrator Job Description. Second by Dick Galbraith. Roll-Call Vote: Chad Anderson – Aye; Dick Galbraith – Aye; Dusty Galliher – Aye; Joanne Justesen – Aye.
Discuss/Approve Maximum Duration of Stay at Heyburn Riverside RV Park
This item was removed from the agenda.
Review of Monthly Department Head Reports
The July 2017 Monthly Department Head Reports were reviewed by those present.
Mayors Time & Committee Reports
Mayor Gallegos thanked City Attorney Michael Tribe for his service to the City.
Councilwoman Joanne Justesen provided a brief report on the Joint Powers Animal Control Board stating that the Joint Powers was given some property in Paul for the care of animals.
Further details including a trust will be brought before City Council in the near future for approval.
Councilman Chad Anderson provided a brief update regarding the 2017 Operation Facelift judging.
