Mayor: Mayor Cleo Gallegos.

 

Council Present: Chad Anderson, Dick Galbraith, and Joanne Justesen.

 

Employees Present:

Paul Ross, Eric Christensen, Dan Bristol, and Ashlee Langley. Tony Morley – excused.

           

Visitors Present:

Kenneth Cox, Carol Cox, Josh Rice, Rose Schmitt, Edward Gemar, Trey King, and Derk Despain.

 

Welcome & Pledge

Meeting conducted by Mayor Cleo Gallegos who welcomed everyone to the meeting.

 

Mayor Gallegos asked Kenneth Cox to lead those present in the Pledge of Allegiance.

 

Discuss/Approve Minutes of the August 23, 2017 Council Meeting & Public Hearing

Motion by Joanne Justesen to approve the minutes of the August 23, 2017 Council Meeting & Public Hearing as presented.  Second by Dick Galbraith. Roll-Call Vote:   Chad Anderson – Aye; Dick Galbraith – Aye; Joanne Justesen – Aye.

 

Discuss/Approve Paying the Bills

Motion by Chad Anderson to approve the bills as presented.  Second by Joanne Justesen. Roll-Call Vote:   Chad Anderson – Aye; Dick Galbraith – Aye; Joanne Justesen – Aye.

 

Update on Minico Ag Program Expansion and Future Growth of Minidoka County School District No. 331 – Kenneth Cox, PH.D.

Kenneth Cox, PH.D. provided those present an update on the Minico Ag Program Expansion and discussed the future growth of Minidoka County School District No. 331. Dr. Cox also provided information to those present regarding the 2018-2020 Plant Facilities Supplemental Levy.

 

Discuss/Approve Spectrum Lease Agreement with Sensus USA Inc.

Water Department Manager Eric Christensen presented the Spectrum Lease Agreement with Sensus USA Inc. to those present. Mr. Christensen stated that this agreement is for the FCC License for the radio read meters.

 

City Attorney Paul Ross stated that he has reviewed this agreement and there is the regular concern about whether or not the Limitation on Liability is unconstitutional and may be found an illegal provision under Idaho’s Constitution. Mr. Ross stated he would prefer that was removed, but recognized most entities will not do so. Mr. Ross stated that the contract seems appropriate, but he would give that warning.

 

Motion by Dick Galbraith to approve the Spectrum Lease Agreement with Sensus USA Inc. as presented authorizing the Mayors signature.  Second by Chad Anderson. Roll-Call Vote:   Chad Anderson – Aye; Dick Galbraith – Aye; Joanne Justesen – Aye.

 

Discuss/Approve or Decline Offer of Terrorism Additional Coverage

Mayor Cleo Gallegos stated the City of Heyburn needs to either accept or decline the Terrorism Coverage as offered by ICRMP at an additional insurance premium amount of $18,059.

 

Motion by Joanne Justesen to decline the Terrorism Coverage offered by ICRMP and to authorize the Mayor’s signature.  Second by Dick Galbraith. Roll-Call Vote:   Chad Anderson – Aye; Dick Galbraith – Aye; Joanne Justesen – Aye.

 

Mayors Time & Committee Reports

Mayor Cleo Gallegos turned some time over to Councilwoman Joanne Justesen for an update on the Joint Powers Animal Control Board.

 

Councilwoman Joanne Justesen provided those present with a copy of the Animal Control approved budget status for the FY 2017 budget.

 

Mayor Gallegos presented a press release where Heyburn was ranked #4 in the top 10 safest cities in Idaho due to its commitment to the safety and security of its residents. Mayor Gallegos recognized Police Chief Dan Bristol, and the Heyburn Police Department for a job well done. Mayor Gallegos stated the City will place the award certificate in a frame and place somewhere in the City.

 

Mayor Gallegos stated that the sign for Central Park is moving forward and that she will have Parks Department Manager Jose Paz send out a picture to the city council of the sign that has been selected.    

 

Mayor Gallegos stated that the City has prepared a Certificate of Appreciation for Dusty Galliher as well as a card to show Heyburn’s appreciation for his service to the City and its residents.

 

Mayor Gallegos took a moment to recognized Trey King with Scout Troop 44.

Mayor Gallegos opened this time up to the public for additional comments.
