May 10, 2017

Mayor: Mayor Cleo Gallegos.

 

Council Present: Chad Anderson, Dick Galbraith, Dusty Galliher, and Joanne Justesen.

 

Employees Present:

Michael Tribe, and Ashlee Langley. Gregory Richins – excused.

 

Visitors Present:

Tony Morley.

 

Meeting conducted by Mayor Cleo Gallegos who welcomed everyone to the meeting.  

 

Executive Session

Pursuant to Idaho Code 74-206(1)(b) to consider the evaluation, dismissal or disciplining of, or to hear complaints or charges brought against, a public officer, employee, staff member or individual agent, or public school student. (f) to communicate with legal counsel for the public agency to discuss the legal ramifications of and legal options for pending litigation, or controversies not yet being litigated but imminently likely to be litigated.

 

Executive Session for (b) personnel and (f) litigation as per Idaho Code 74-206

Motion by Dusty Galliher to go into Executive Session for (b) personnel and (f) litigation as per Idaho Code 74-206. Second by Joanne Justesen. Roll-Call Vote:   Chad Anderson – Aye; Dick Galbraith – Aye; Dusty Galliher – Aye; Joanne Justesen – Aye.

 

Executive Session Minutes

The Executive Session was conducted by Mayor Cleo Gallegos. The topics were a matter ofpersonnel and litigation. No decisions were made. 

 

Tony Morley was excused from executive session at 6:38 PM.

 

Motion by Dusty Galliher to adjourn Executive Session for (b) personnel and (f) litigation as per Idaho Code 74-206. Second by Joanne Justesen. Roll-Call Vote:   Chad Anderson – Aye; Dick Galbraith – Aye; Dusty Galliher – Aye; Joanne Justesen – Aye.

 

The Executive Session began at 6:10 pm and concluded at 6:57 pm.

Welcome & Pledge

Meeting conducted by Mayor Cleo Gallegos who welcomed everyone to the meeting.

 

Mayor Gallegos asked Heyburn Resident Heather Petersen to lead those present in the Pledge of Allegiance.

 

Discuss/Approve Minutes of the April 26, 2017 Council Meeting

Motion by Joanne Justesen to approve the minutes of the April 26, 2017 Council Meeting as presented.  Second by Chad Anderson. Roll-Call Vote:   Chad Anderson – Aye; Dick Galbraith – Aye; Dusty Galliher – Aye; Joanne Justesen – Aye.

 

Discuss/Approve Paying the Bills

Motion by Dick Galbraith to approve the bills as presented.  Second by Chad Anderson. Roll-Call Vote:   Chad Anderson – Aye; Dick Galbraith – Aye; Dusty Galliher – Aye; Joanne Justesen – Aye.

 

Discuss/Approve Waiver of Fees for Use of Central Park - The Springs Calvary Chapel

Dallas Brudererer with the Springs Calvary Chapel asked the City Council to consider waiving the fees for the use of Central Park June 5th through June 9th from 11:30 am to 1:30 pm. for the Gospel on the Green event.

 

Before discussion on this item, Councilwoman Joanne Justesen disclosed that she is a member of the Springs Calvary Chapel but felt this association would not affect or sway her decision in the waiver for the use of Central Park.

 

Motion by Dusty Galliher to approve waiving the fees for the use of Central Park for the Lunch in the Park program from June 5, 2017 through June 9, 2017 but to require liability insurance. Second by Joanne Justesen. Roll-Call Vote:   Chad Anderson – Aye; Dick Galbraith – Aye; Dusty Galliher – Aye; Joanne Justesen – Aye.

 

Discuss/Approve Temporary Livestock Waiver – Dan Sullivan

City Resident Dan Sullivan asked the city council to consider a temporary livestock waiver to allow him to have goats on his property located at 2020 H Street. The current city code states ½ an acre is required so Mr. Sullivan was denied a permit from Code Enforcement Officer Michael Devers.

 

After a brief discussion, the council offered to help Mr. Sullivan in reaching out to the community to assist him with his property.

 

Discuss/Accept Letter of Resignation from City Superintendent Gregory Richins

Mayor Gallegos announced she received a Letter of Resignation from City Superintendent Gregory Richins on May 2, 2017 effective May 12, 2017.

 

Motion by Dusty Galliher to accept the Letter of Resignation from City Superintendent Gregory Richins dated effective May 12, 2017. Second by Joanne Justesen. Roll-Call Vote:   Chad Anderson – Aye; Dick Galbraith – Aye; Dusty Galliher – Aye; Joanne Justesen – Aye.

 

Discuss/Approve Letter of Acceptance for the 21st Street Project – Robert Ramsey

Robert Ramsey, Project Engineer with Civil Science asked the council for a Letter of Acceptance for the 21st Street Project. Mr. Ramsey explained that Street Department Manager Anson Parke performed a final walk through on the project May 9, 2017 and verified the original punch list was completed.

 

Motion by Joanne Justesen to approve the Letter of Acceptance for the 21st Street Project as presented.  Second by Dick Galbraith. Roll-Call Vote:   Chad Anderson – Aye; Dick Galbraith – Aye; Dusty Galliher – Aye; Joanne Justesen – Aye.

 

Discuss/Approve Final Plat Application for the Boulevard Phase 1 Development

Planning & Zoning Administrator Tony Morley presented the Final Plat Application for the Boulevard Phase 1 Development to those present. Mr. Morley informed the council that the application came in two days past the deadline set by council at the March 8, 2017 council meeting.

 

Motion by Joanne Justesen to approve the Final Plat Application for the Boulevard Phase 1 Development. Second by Chad Anderson. Roll-Call Vote:   Chad Anderson – Aye; Dick Galbraith – Aye; Dusty Galliher – Nay; Joanne Justesen – Aye.

 

Discuss Economic Growth

Wastewater Manager Ralph Martini asked the council to continue to think about how they would like to move forward with capacity for non-residential growth.

Discuss/Approve Implementation of a Water Cost of Service Study

Water Department Manager Eric Christensen provided the council with a quick update regarding the idea of implementing a Water Cost of Service Study. Mr. Christensen informed the council that documentation is still being gathered to bring before council.

 

This item was briefly discussed, no decisions were made.

 

Discuss/Approve Minidoka County Fire Protection District Letter of Support

Minidoka County Fire Protection District Fire Chief Mike Brown presented the Minidoka County Fire Protection District Letter of Support to those present.

 

Motion by Joanne Justesen to approve the Minidoka County Fire Protection District Letter as presented authorizing the Mayors signature. Second by Chad Anderson. Roll-Call Vote:   Chad Anderson – Aye; Dick Galbraith – Aye; Dusty Galliher – Aye; Joanne Justesen – Aye.

 

Discuss Elected Officials Salaries

After a brief discussion, no decisions were made.

 

Discuss/Appoint Planning & Zoning Replacement Member

Mayor Cleo Gallegos asked the council to consider the appointment of Rose Schmitt as the newest member to the Planning & Zoning Commission.

 

Motion by Dick Galbraith to appoint Rose Schmitt as the newest member to the Planning & Zoning Commission. Second by Joanne Justesen. Roll-Call Vote:   Chad Anderson – Aye; Dick Galbraith – Aye; Dusty Galliher – Aye; Joanne Justesen – Aye.

 

Mayors Time & Committee Reports

Mayor Gallegos congratulated Police Officer Ririe Thomander on completing his post certification. Mayor Gallegos asked Police Chief Dan Bristol to formally present Mr. Thomander with his certificate.

 

Comments from the Public

Mayor Gallegos opened this time up to the public for additional comments.

 

Police Chief Dan Bristol announced that Monday, May 15, 2017 is Peace Officers’ Memorial Day and the week in which it falls in is law enforcement week so all flags will be at half-staff.
