Welcome & Pledge
Meeting conducted by Mayor Cleo Gallegos who welcomed everyone to the meeting. Mayor Gallegos took a moment to recognize the attendance of Scout Group #48.
Mayor Gallegos asked Noah George with Scout Group #48 to lead those present in the Pledge of Allegiance.
Discuss/Approve Minutes of the November 20, 2017 Special Council Meeting

Public Hearing for the Proposed Rate Increases (Each person has 3 min. to comment).
City Administrator Tony Morley and Matt Millis, Vice President for Zions Public Finance conducted a presentation on the need for increases to the water, wastewater, and irrigation rates.
Mayor Gallegos opened the public hearing.
Those speaking in favor of the proposed rate increases were: None
Those speaking against the proposed rate increases were: Edward Gemar raised questions regarding the notice of hearing process.
Those speaking neither in favor of nor against the proposed rate increases were: Noah George asked why the rate proposal spikes in 2020 and 2021.
Hearing no public comments, Mayor Gallegos closed the public hearing.
Discuss /Adopt Resolution No. 2017-7 Water, Sewer, and Irrigation Rate Increases, limiting standard pipe size for hook-up.
RESOLUTION NO. 2017-7
RESOLUTION OF THE CITY OF HEYBURN, AMENDING WATER, SEWER, AND IRRIGATION RATES ENACTED PURSUANT TO HEYBURN CITY CODE, AND PROVIDING EFFECTIVE DATE.
City Attorney Paul Ross read statute 63-1311 as well as 50-1028 to those present. Mr. Ross reviewed notice and publication requirements for the hearing and explained the City’s duty to operate these funds in a financially responsible manner.
George Brisbin stated he received notice regarding the hearing on Monday by a phone call.
City Administrator Tony Morley addressed notice of hearing that was posted on the City’s Website, Post Office, Police Department, and City Hall, as well as the advertisement in the Times-News.
The council expressed relief that the rates were not as bad as originally proposed last month.
After discussion about the need to raise rates, Council voted.
Motion by Joanne Justesen to adopt Resolution No. 2017-7 Rate Increases as presented. Second by Chad Anderson. Roll-Call Vote: Chad Anderson – Aye; Dick Galbraith – Aye; Joanne Justesen – Aye.
Public Hearing on the Adoption of the 2015 Version of the International Building Codes
City Administrator Tony Morley presented the 2015 Version of the International Building Codes to those present stating that the City adopted the 2012 Version of the International Building Codes in 2014. Mr. Morley recommended the council adopt a portion of the 2015 Version of the International Building Codes excluding the Energy Conservation Code portion.

Mayor Cleo Gallegos announced the resignation of Nick Telleria and asked those present to be thinking of a replacement member.
Discuss / Approve Appointment for Planning & Zoning Commission
Mayor Gallegos stated that she is still accepting volunteer applications for two additional members to appoint to the Planning & Zoning Commission. These applications can be found at City Hall or on the city’s website.
Discuss Monthly Department Head Reports
The Monthly Department Head Reports were reviewed by those present.
Mayors Time & Committee Reports
Councilwoman Joanne Justesen provided those present with an update on the Minidoka Joint Animal Control. Councilwoman Justesen stated that the Minidoka County Board of Commissioners entered into a Trust Agreement for the estate of Diane M. Gellings and they are now seeking three volunteers to appoint as trustees on the board. No two trustees can be members of the same city and shall not be members of the Joint Animal Control Board. Councilwoman Justesen asked those present to be thinking of an individual to serve on this board from the City of Heyburn.
Mayor Gallegos announced that the City received a check in the amount of $1,000 for the Mayors Walking Challenge that she took part in and will be donating it to the Heyburn Elementary School physical education program.
Mayor Gallegos took a moment to read a letter from the Department of Environmental Equality recognizing the City for the recent completion of the Source Water Protection Plan update. Mayor Gallegos gave special recognition to Water Department Manager Eric Christensen for a job well done.
