Mayor: Mayor Cleo Gallegos.

 

Council Present: Joanne Justesen, Chad Anderson, Dick Galbraith, and Dusty Galliher.

Welcome & Pledge

Meeting conducted by Mayor Cleo Gallegos who welcomed everyone to the meeting.

 

Mayor Gallegos asked Councilman Dusty Galliher to lead those present in the Pledge of Allegiance.

 

Discuss/Approve Minutes of the August 9, 2017 Council Meeting

Motion by Dusty Galliher to approve the minutes of the August 9, 2017 Council Meeting as presented.  Second by Joanne Justesen. Roll-Call Vote:   Chad Anderson – Aye; Dick Galbraith – Aye; Dusty Galliher – Aye; Joanne Justesen – Aye.

 

Discuss/Approve Paying the Bills

Motion by Dick Galbraith to approve the bills as presented.  Second by Chad Anderson. Roll-Call Vote:   Chad Anderson – Aye; Dick Galbraith – Aye; Dusty Galliher – Aye; Joanne Justesen – Aye.

 

Public Hearing on the FY 2017-18 Budget

Cleo Gallegos opened the public hearing for the FY 2017-18 Budget.

 

Those speaking in favor of the FY 2017-18 Budget were: None.

 

Those speaking against the FY 2017-18 Budget were:  None.

 

Those speaking neither against nor in favor of the FY 2017-18 Budget were: None.

Discuss/Approve/Adopt Ordinance No. 17-590 – Annual Appropriation Ordinance

 – With Suspension of the Rule Requiring Three Reading and Adopt in One Reading

ORDINANCE NO. 17-590
 
AN ORDINANCE ENTITLED THE ANNUAL APPROPRIATION ORDINANCE FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2017, APPROPRIATING THE SUM OF $10,905,933 TO DEFRAY THE EXPENSE AND LIABILITIES OF THE CITY OF HEYBURN FOR SAID FISCAL YEAR, AUTHORIZING A LEVY OF A SUFFICIENT TAX UPON THE TAXABLE PROPERTY AND SPECIFYING THE OBJECTS AND PURPOSES FOR WHICH SAID APPROPRIATION IS MADE.

 

Motion by Joanne Justesen to have City Attorney Paul Ross read Ordinance No. 17-590 – Annual Appropriation Ordinance by title only for its first and only reading.  Second by Dick Galbraith. Roll-Call Vote:   Chad Anderson – Aye; Dick Galbraith – Aye; Dusty Galliher – Aye; Joanne Justesen – Aye.

           

City Attorney Paul Ross read Ordinance No. 17-590 once by title only.

 

Motion by Joanne Justesen to adopt Ordinance No. 17-590 – Annual Appropriation Ordinance. Second by Dick Galbraith.  Roll-Call Vote:   Chad Anderson – Aye; Dick Galbraith – Aye; Dusty Galliher – Nay; Joanne Justesen – Aye.

 

Public Hearing Robinson Street Vacation

– A Part of “C” Street north of 20th Street and Part of 20th Street between “B” and  “Cassia” Street

 

Cleo Gallegos opened the public hearing for the Robinson Street Vacation.

 

Those speaking in favor of the Robinson Street Vacation were: Kent Fletcher, Attorney at Law spoke on behalf of the Robinsons stating that the vacation would consist of a part of “C” Street north of 20th Street and Part of 20th Street between “B” and “Cassia” Street and the vacation would simply free up the Robinson’s property. As it is now, part of the Robinson property sits on the City Street. Mr. Fletcher stated that his client would not object to the street vacation.

 

Those speaking against the Robinson Street Vacation were:  None.

 

Those speaking neither against nor in favor of the Robinson Street Vacation were: None.

Discuss/Approve/Adopt Ordinance No. 17-588 Robinson Street Vacation Ordinance

 – With Suspension of the Rule Requiring Three Readings and Adopt in One Reading

ORDINANCE NO. 17-588
 
AN ORDINANCE OF THE Mayor and CITY council OF HEYBURN, IDAHO, vacating a portion of a public street in the city of heyburn, idaho, described generally as part of “c’ street north of 20th Street and part of 20th street between “B” and “Cassia” street, said property contains 0.97 acres, DECLARING THE REVERSION OF THE PROPERTY, preserving and reserving easements AND FINDING IT IN THE BEST INTERESTS OF ADJOINING PROPERTIES, and providing an effective date.

 

Motion by Dusty Galliher to have City Attorney Paul Ross read Ordinance No. 17-588 – Robinson Street Vacation Ordinance by title only for its first and only reading.  Second by Dick Galbraith. Discuss/Approve Taking over Roads in Phase 1 of Blue River Estates

City Administrator Tony Morley stated that the City was approached by Roy Belnap to take over the roads in Blue River Estates for Phase 1. Mr. Morley stated that Mr. Belnap has completed everything the City requested of him and he would recommend the council accept the streets in Phase 1 as proposed.

 

Motion by Dick Galbraith to approve taking over the roads in Phase 1 of Blue River Estates. Second by Chad Anderson.  Roll-Call Vote:   Chad Anderson – Aye; Dick Galbraith – Aye; Dusty Galliher – Aye; Joanne Justesen – Abstain.

 

Discuss/Approve LIHEAP 2017-18 Vendor Agreement

City Clerk Ashlee Langley stated that LIHEAP stands for Idaho Low Income Home Energy Assistance Program, and that the program assists individuals with energy costs. Mrs. Langley also stated that in order to participate in the LIHEAP season the following agreement must be signed and returned to South Central Community Action by October 1, 2017.

 

Motion by Joanne Justesen to approve the LIHEAP 2017-18 Vendor Agreement as presented. Second by Dick Galbraith.  Roll-Call Vote:   Chad Anderson – Aye; Dick Galbraith – Aye; Dusty Galliher – Aye; Joanne Justesen – Aye.

 

Discuss/Approve/Appoint Building Official

City Administrator Tony Morley stated that the City does not have their own Building Department at this time, but according to the Building Codes the City has adopted, they need to appoint a Building Official. Appointing a Building Official would allow the City to have a little direction over the building codes they have adopted. The City would still allow Minidoka County to contract the permits until the City is in a position to take them over.

 

Mayor Cleo Gallegos stated she would like to appoint City Administrator Tony Morley as the Building Official and asked for the council to affirm her decision.

 

Motion by Dick Galbraith to approve the appointment of Tony Morley as the Building Official for the City. Second by Dusty Galliher.  Roll-Call Vote:   Chad Anderson – Affirm; Dick Galbraith – Affirm; Dusty Galliher – Affirm; Joanne Justesen – Affirm.

 

The appointment of City Administrator Tony Morley as Heyburn’s Building Official was affirmed by all four members of the City Council.

 

Discuss/Approve Purchase of Radio Read Playbook Package from Ferguson Waterworks

Water Department Manager Eric Christensen presented the purchase of a Radio Read Playbook Package from Ferguson Waterworks to those present. Mr. Christensen explained that this is the initial step in moving forward with the water and electric meter upgrades. Mr. Christensen explained that the price of $18,359.08 includes 24 Sensus iPERL meters, one handheld with integrated GPS, one command link, one auto read software, one day of training, and a one year of support.

 

Motion by Dick Galbraith to approve the purchase of the Radio Read Playbook Package from Ferguson Waterworks in the amount of $18,359.08 with the understanding that additional days of training will be $1,562.50 per day. Second by Chad Anderson.  Roll-Call Vote:   Chad Anderson – Aye; Dick Galbraith – Aye; Dusty Galliher – Aye; Joanne Justesen – Aye.

 

Review of Monthly Department Head Reports

The August 2017 Monthly Department Head Reports were reviewed by those present.

 

Mayors Time & Committee Reports

Mayor Gallegos thanked the City crew for the work they put into completing the sidewalk in front of City Hall.

 

Mayor Gallegos stated that the City is in the process of getting quotes for a sign at Central Park as well as a sign off of Highway 30 by Gossner’s.

 

Mayor Gallegos read a letter from Mike Crapo recognizing the City for receiving the 2016 Tree City USA Award. Mayor Gallegos stated that Wastewater Department Manager Ralph Martini put together a legacy video for retired employee Earl Andrew. Mayor Gallegos turned the time over to City Administrator Tony Morley to play the video. Mayor Gallegos thanked the Parks Department for all their hard work.

 

Mayor Gallegos then turned the time over to Councilman Dusty Galliher.

 

Councilman Dusty Galliher read:

Economic values in the Magic Valley have made it possible for my wife and I to find some property north of Filer and we have been able to build our retirement home there. We are going to be retiring after the McCain build project is completed where I work. Fortunately or unfortunately our home here in Heyburn has sold faster than we have anticipated. I have been very fortunate to have the Citizens of Heyburn entrust me in the welfare of the City. And I thank them very much for that trust. I have tried very hard for the past three and a half years as your councilman to keep the city fiscally strong. I have learned very quickly this isn’t an easy task even in a small city. Two people that have been my friends and mentors the late Rocky Baker who which I worked very closely with at McCain’s and Mike Tribe who is now Judge Tribe have both helped me understand how city government works and because of them I feel it has made me a better person for it. Idaho State Statute states that for a City council person to serve they must reside in the City limits. We will be moving from Heyburn before the next council meeting and I will be living in Twin Falls until our home is finished in November. With a heavy heart and sadness I’m resigning my seat as City Councilman effective tonight at the close of this meeting. To the council and the Mayor, it has been a pleasurable experience to work for all of you. To the residents of Heyburn, thank you again for the opportunity you have given me and may God bless you all.

 

Mayor Gallegos and Councilmembers thanked Dusty Galliher for his service to the City of Heyburn.

 

Mayor Gallegos stated she will be leaving Mr. Galliher’s seat vacant until the election in November.
